CONSIDER adopting Resolution No. 2011/320 allowing the Contra Costa County
Clerk-Recorder and the Contra Costa County District Attorney to move forward with a joint
Real Estate Fraud Notification program to protect Contra Costa County citizens and to
investigate and prosecute those that present fraudulent recordings.
FISCAL IMPACT:
There is no fiscal impact on the County General Fund for this program. This joint project
will be funded by dedicated Real Estate Fraud Prosecution Funds.
BACKGROUND:
The Real Estate Fraud Prosecution Fund was first established in 1995 by SB 537 and
codified in Government Code Section 27388, with the purpose to investigate, deter, and
prosecute real estate fraud involving recorded real estate documents. The technology now
exists that will enable the Contra Costa County Clerk-Recorder to verify and notify the legal
owner of record of a recorded document.

BACKGROUND: (CONT'D)
Costa County District Attorney and Clerk-Recorder desire to partner to provide a real
estate fraud notification program as a deterrent to real estate fraud as well as an avenue
for investigation and prosecution of fraudulent real estate transactions.
CONSEQUENCE OF NEGATIVE ACTION:
If Contra Costa County does not approve of this notification project, property owners will
not be notified of potentially fraudulent transactions made against their property.
