HomeMy WebLinkAboutMINUTES - 07262011 - C.60RECOMMENDATION(S): APPROVE and AUTHORIZE the County Counsel, or designee, to execute on behalf of Contra Costa County, an agreement for specialized professional legal services with Greenan, Peffer, Sallander & Lally in connection with assigned eminent domain cases, assessment appeals and related matters, as recommended by the County Counsel. FISCAL IMPACT: Varies with services rendered in assigned cases. Eminent domain services under this contract are billed at a rate of $265 per hour for attorneys. Other legal services under this contract are billed at a rate of $250 per hour for partners and $200 per hour for associates. Any future increases are subject to prior written approval by County Counsel. Eminent domain and real property matters will be charged to pertinent project accounts. Assessor matters will be charged to Budget Org. No. 1600, Account No. 2310. BACKGROUND: The Public Works Department is involved in various projects in the County that require the use of eminent domain. Anderson, County Counsel Date:July 26, 2011 Contra Costa County Subject:Contract with Greenan, Peffer, Sallander & Lally for Specialized Legal Services BACKGROUND: (CONT'D) Lally, a partner at the law firm of Greenan, Peffer, Sallander & Lally, is associated with County Counsel as co-counsel in a number of eminent domain actions for the County, and for the State Route 4 Bypass Authority, a joint powers authority of which the County is a member. The Public Works Department recommends, and County Counsel concurs, that the services of Mr. Lally continue to be retained for assigned eminent domain and related purposes. In addition, the Assessor requires specialized legal assistance regarding assessment appeals and related matters. Mr. Lally is associated with County Counsel as co-counsel in pending assessment appeals and Superior Court litigation involving assessment appeals. The Assessor recommends and County Counsel concurs that the services of Mr. Lally continue to be retained for assigned assessment appeals and related matters. The term of this contract extends through the completion of all assigned matters. CONSEQUENCE OF NEGATIVE ACTION: The County would not be able to obtain legal services from this firm.
