APPROVE a Third Amendment to Lease with HPH Properties, L.P., dba Equus Group, to extend the term of the lease for a two-year period and to reduce the monthly rent from $2,445 to $1,972, commencing August 1, 2011 and ending July 31, 2013, for 1,578 square feet of office space at 1191 Central Boulevard, Suite C, Brentwood, for continued occupancy by the Department of Conservation and Development, under the terms and conditions set forth in the Third Amendment to Lease. 2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE the Third Amendment to Lease, and EXERCISE any options to extend the Lease. RECOMMENDATION(S): (CONT'D) 3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#11-27; WLP726) 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy General Services Director, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption. FISCAL IMPACT: The Third Amendment to Lease will obligate the County to pay a total rent of $47,280 over the two-year extended term. The Third Amendment to Lease is an extension of an existing Lease and represents a decrease in rent of approximately $11,400 (approximately 19%) over the two-year term. The Third Amendment to Lease includes two additional one-year options to extend the Lease at the same rent. Lease costs were anticipated and budgeted in the Department of Conservation and Development’s, Land Development Fees, FY 2011/12 budget. Non-general fund monies will be used to pay costs associated with this Lease. BACKGROUND: On December 18, 2001, the Board of Supervisors approved a Lease between the County and HPH Properties, L.P., dba Equus Group, for occupancy of office space by the Department of Conservation and Development’s (DCD) Building Inspection Division. The office space was designed and built specifically for DCD’s use. This Third Amendment to Lease provides for the County’s continued occupancy of those premises by DCD. As part of the RAMP evaluation, it was determined there were no County-owned facilities in the region that could be used for this occupancy. CONSEQUENCE OF NEGATIVE ACTION: If the Third Amendment to Lease is not approved, the County would have to relocate to another location at considerable expense to make the new location suitable for DCD’s needs.
