APPROVE the Vasco Road Safety Improvements Phase 1 project contingency fund increase
of $200,000 for a new contingency fund total of $1,407,424, and a new payment limit of
$9,981,663 effective July 12, 2011, and APPROVE and AUTHORIZE the Director of
Public Works, or designee, to execute Contract Change Order No. 33 with Teichert
Construction, effective July 12, 2011 in an amount not to exceed $167,000 to allow
additional payment for certain items of work involving asphalt binder due to market price
fluctuations. Brentwood/Byron area (90% American Recovery and Reinvestment Act
(ARRA) funds; 10% Road funds) Project No. 0662-6R4254-09
FISCAL IMPACT:
The $200,000 increase in contingency funds will be funded by American Recovery and
Reinvestment Act (ARRA) funds (90%) and Road funds (10%).
BACKGROUND:
Contract Specifications for the Vasco Road Safety Improvements – Phase 1 project allow
the contractor to receive compensation for price index fluctuations on the following items of
work that have asphalt binder: Hot mix asphalt and asphalt treated permeable base.

Subject:APPROVE contingency fund increase of $200,000 for the Vasco Road Safety Improvements Phase 1 project.
BACKGROUND: (CONT'D)
Since the price of asphalt binder (i.e. oil) has increased since the project bids were opened
in February 2010, the contractor is due additional money to compensate for the additional
material cost for certain items of work that contain asphalt binder. The California
Statewide Paving Asphalt Price Index for February 2010 was 377.0; that same price index
was 667.5 in May 2011 (refer to
http://www.dot.ca.gov/hq/esc/oe/asphalt_index/astable.html). The contractor will be paid
based on the price index which is in effect on the first business day of the month within
the pay period in which the quantity subject to adjustment was included in the estimate.
The requested increase of $200,000 to the project contingency fund will cover the
estimated cost of the compensation adjustments for certain items of work that include
asphalt binder plus provide a small balance for additional unforeseen charges that may
occur over the final four (projected) months of construction through November 2011.
The Vasco Road Safety Improvements – Phase 1 project includes the widening of a 1
mile stretch of Vasco Road approximately 4 miles north of the Contra Costa/Alameda
County line to install a southbound passing lane and concrete median barrier.
Construction of the project began in May 2010 and is expected to be complete by
November 2011
CONSEQUENCE OF NEGATIVE ACTION:
The lack of approval would prevent successful completion of this contract and preclude
payment to the contractor for compensation due to them for market price fluctuations for
asphalt binder.
