HomeMy WebLinkAboutMINUTES - 06282011 - C.58RECOMMENDATION(S): Approve and Authorize the Health Services Director, or designee (Environmental Health Director), to execute, on behalf of the County, Grant Agreement #28-759-6 (TEA18-10-1) with California Department of Resources Recycle and Recovery (CalRecycle) to pay the County an amount not to exceed $282,448, for the Environmental Health Waste Tire Enforcement Program, for the period from June 30, 2011 through September 28, 2012. FISCAL IMPACT: Approval of this grant agreement will result in an amount not to exceed $282,448 of funding from the CalRecycle, for the 2010/2011 fiscal year of the Environmental Health Waste Tire Enforcement Program, for the period from June 30, 2011 through September 28, 2012. The funds are allocated and available from CalRecycle for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the city and county government to perform enforcement/compliance and surveillance activities at waste tire facilities. No County match required. CalRecycle has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program. Contra Costa County (CCC) demonstrates it has sufficient staff resources, technical expertise, and/or experience with similar projects to carry out the proposed program. California has more registered vehicles than any other state. As a result, approximately 40.2 million reusable and waste tires are generated each year. About 1.5 million waste tires are already stockpiled throughout the state, posing a health and safety risk for the public. California Department of Resources Recycle and Recovery (CalRecycle) is dedicated to finding new uses for these valuable resources, and to work in cooperation with local governments, such as Contra Costa County (CCC), industries, and the public towards reaching their goals. With this funding, CCC will be able to monitor and reduce illegal waste tire practices, educate and enforce proper waste tire management throughout the county, assist in reducing potential vector problems and preventing tires fires and otherwise protecting public health and safety. Approval of Grant Agreement #28-759-6 will allow Cal Recycle to pay the County to support the Environmental Health Waste Tire Enforcement Program through September 28, 2012, including agreeing to indemnify and hold the State harmless for claims arising out of the County’s performance under the Agreement. CONSEQUENCE OF NEGATIVE ACTION: If this Agreement is not approved, the County will not be able to monitor and reduce illegal waste tire practices, educate and enforce proper waste tire management throughout the County, assist in reducing potential vector problems and prevent tire fires, nor protect public health and safety.
