APPROVE a Termination of Lease Agreement with Balco Properties, Ltd., LLC, effective June 30, 2011, for the Health Services Department’s use of approximately 2,000 square feet of warehouse space at 835 Arnold Drive, Bay 4, Martinez; and APPROVE the Lease with Balco Properties, Ltd., LLC, effective July 1, 2011, for the Health Services Department’s use of approximately 1,746 square feet of warehouse space at 825 Arnold Drive, Bay 8, Martinez, for $1,019 per month under terms and conditions set forth in the Lease. 2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE both the Termination of Lease Agreement and the Lease. RECOMMENDATION(S): (CONT'D) 3. DETERMINE the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy General Services Director, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption. FISCAL IMPACT: The new lease will obligate the County to pay rent of $44,592 over the three-year term of the Lease, which represents a savings to the Health Services Department of approximately $18,384 in lower rent over that period. The County will pay for PG&E, refuse and janitorial costs. The Lessor has agreed to pay the cost of moving from the larger space to the smaller space. The lease costs were anticipated and budgeted in the Health Service Department’s FY 2011/12 budget. BACKGROUND: The County currently occupies leased warehouse space at 835 Arnold Drive, Bay 4 in Martinez. The Lessor requested that the County move to another warehouse space in an adjacent building to provide room for the neighboring tenant to expand. As an incentive to having the County move, the Lessor will take down, relocate, and reconstruct the storage racks from the current space to the new space at its cost and at a lower rent. CONSEQUENCE OF NEGATIVE ACTION: If the Termination of Lease Agreement and Lease are not approved, the County will not receive the savings in rent and the Health Services Department will not realize better efficiency by moving to a smaller warehouse space.
