1. APPROVE a Library Lease and Service Agreement with the City of Martinez, enabling
the County to operate the Martinez Library located at 740 Court Street, Martinez, for a
one-year term beginning on July 1, 2011, which term will automatically renew unless
otherwise terminated, as requested by the County Librarian.
2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE the
Library Lease and Service Agreement on behalf of the County.
3. DETERMINE the project is a Class 1(a) Section 15301 Categorical Exemption under the
California Environmental Quality Act (CEQA).
4. DIRECT the Department of Conservation and Development Director, or designee, to file
a Notice of Exemption with the County Clerk, and DIRECT the Deputy Director of General
Services, or designee, to arrange for the payment of the handling fees to the Department of
Conservation and Development and County Clerk for filing of the Notice of Exemption.

Subject:740 COURT STREET, MARTINEZ - LEASE WITH THE CITY OF MARTINEZ FOR COUNTY'S
OPERATION OF THE MARTINEZ LIBRARY
FISCAL IMPACT:
No rent is due or payable from the County. In exchange for the use of the Library premises,
the County will perform Library services and related activities at the Library during the
Term. The City will pay for and provide all maintenance, utilities, and janitorial to the
Library.
The County Library has included $412,591 in its FY 11/12 budget for the personnel costs
necessary for the operation of the Martinez Library for 35 hours per week.
BACKGROUND:
The County has leases or operating agreements with 18 towns and cities throughout Contra
Costa County to operate 21 libraries in those jurisdictions. Many of those existing
agreements provide that the County will pay for the maintenance and utilities provided to
those libraries. For the purpose of reallocating Library resources, and transferring the cost
of maintenance, utilities, and other facility costs in the buildings from the County to the
cities and towns, the County and a subcommittee of the Public Managers Association,
which included City Managers and attorneys from several cities and towns, worked together
to develop a template Library Lease and Service Agreement that would be used to replace
existing Library leases. The Board of Supervisors approved the new Library Lease and
Service Agreement on November 2, 2010.
The County and the City of Martinez (City), entered into a Lease agreement in 1941 for the
County to provide library services from the building. The County and City are replacing the
existing lease with the new Library Lease and Service Agreement that will provide that the
County will operate the Martinez Library for 35 hours each week. The City of Martinez
City Council approved the Library Lease and Service Agreement on November 10, 2010.
The new Library Lease and Service Agreement provides that the Term will automatically
renew on a yearly basis unless written notice is given by either party of their intent to
terminate the Lease at least one year in advance.
CONSEQUENCE OF NEGATIVE ACTION:
If the Library Lease and Service Agreement is not approved, there may be a reduction in
library services in the City of Martinez.
