(Julie Enea, County Administrator's Office) Speaker: Fred Dectorchio, Contra Costa County Police Chiefs spoke in opposition to the proposed increase. ADOPTED Resolution No. 2011/282 regarding the intention of the Board of Supervisors to align the wages and benefits of County department heads, managers, and unrepresented employees to be consistent with the terms and conditions of employment reached with Professional and Technical Engineers, Local 21, AFL-CIO (Local 21) for the period beginning on July 1, 2011, as amended today to include the members of the Board of Supervisors. Glover 10.SD. 12 CONSIDER approving a response to Civil Grand Jury Report No. 1107, entitled "County Pension Reform"; and DIRECT the Clerk of the Board to forward response to the Superior Court by July 26, 2011. (David Twa, County Administrator) Speakers: Wendy Lack, resident of Pleasant Hill; Kris Hunt, Contra Costa Taxpayers Association; Rollie Katz, Public Employees' Union, Local One. Minutes The Board approved the response to Grand Jury Report No. 1107 as amended today with changes as follows: Finding No. 4 : Response: Disagree. The Board can design a new pension tier for new hires, but must obtain the unions’ agreement to the terms of the new tier. Legislation would be required to authorize the new tier for newly hired general members. As to safety members, the need for legislation depends on whether the elements of the new tier are already in the County Employees Retirement Law (CERL). Any aspects not currently in the CERL would require legislation. The Board must obtain the unions’ agreement on the use of three year averaging to calculate final compensation for new hires. Legislation would be required to authorize this change for newly hired general members. Finding 10 : Response: Agree that pension reform is complex and agree that there are differing legal opinions on what can be done, who can make it happen and when it can be done. Disagrees that these issue have led to public interest. Public interest is due to significantly increased costs from higher salaries, earlier retirements, and retirees living longer. These costs have been exacerbated by the stock market losses of 2008, which have led to projections of reduced services to the public in order to fund the obligations. Recommendation 4 : Response: The recommendation cannot be implemented because it would require the Board to take unilateral action outside the labor negotiations process. The Board is currently engaged in labor negotiations with most of the recognized employee organizations. AYE: District I Supervisor John Gioia, District II Supervisor Gayle B. Glover 11.SD. 13 CONSIDER accepting recommendation by the Airport Committee and report by Director of Airports to update security procedures at Buchanan Field Airport, Pacheco area. Glover 12.SD. 14 CONSIDER a request of the Delta Counties Coalition (DCC) from Solano County to urge our congressional delegation to cosponsor Representative Gary Miller's bill, the Flood Control Facility Maintenance Clarification Act, to provide a narrow exemption for maintenance removal of sediment, debris, and vegetation from flood control channels and basins, to streamline the Clean Water Act’s (CWA) Section 404 permitting process. (Supervisor Piepho) The Board DIRECTED that the letter from the Delta Counties Coalition to our congressional delegation not be sent out until a response from Congressman George Miller’s office had been received on their receptivity to the request, and that staff report back to the Board on the outcome of the matter as a Consent item at a future Board agenda. Glover DELIBERATION ITEMS 13.D. 1 CONSIDER approving County membership in the Bay Area Regional Interoperable Communications System (BayRICs) Authority with an annual membership fee of $24,500; approving and authorizing the Chair, Board of Supervisors, to execute the Joint Powers of Agreement (JPA) for the BayRICs Authority; and appointing Supervisor Gayle B. Uilkema as the Board of Supervisors' representative and Supervisor Federal D. Glover as the alternate representative to the Authority, as recommended by the Public Protection Committee. Supervisor Piepho attended the retirement celebration of Mitch Avalon of Public Works on June 24, 2011 and presented the Resolution from the Board of Supervisors; Supervisor Uilkema attended the International Conference of the Air and Waste Management Association in Florida last week. 14.D. 3 Informal UPDATE on pending state and federal legislation. (David Twa, County Administrator) County Administrator, Mr. David Twa, stated both houses of the state legislature are meeting this afternoon at 4:00 p.m. to vote upon the proposed budget. Assuming that the budget passes, the County does not need to make adjustments to its currently adopted budget. Mr. Twa noted that the states proposed budget includes an estimated $4 billion in new revenue, and if the new revenue fails to occur, it would initiate automatic triggers in the state budget in January 2012, affecting Health and Human Services. Glover 25.C. 10 APPROVE the Deer Valley Road Shoulder Widening Project; and AUTHORIZE the Public Works Director, or designee, to advertise the project, and make related findings under the California Environmental Quality Act (CEQA), Brentwood area. (60.5% Prop. 1B, 34% Federal HR3, and 5.5% Gas Tax Funds) Speakers: Tony Allegra and Cheryl Allegro, residents along Deer Valley Road expressed concerns about the impacts to their property resulting from the improvement project. The Board requested Public Works staff meet with the property owners to address their concerns. This matter is RELISTED to July 12, 2011.
