HomeMy WebLinkAboutMINUTES - 06212011 - C.59RECOMMENDATION(S): APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute the annual Final Intent to Participate in the Electronic Recording Delivery System (ERDS) with the California Department of Justice for the period July 1, 2011 through June 30, 2012. FISCAL IMPACT: There is no fiscal impact on the County General Fund for this program. Participation in ERDS is funded by dedicated Electronic Recording Trust Fund monies (2454). The cost is determined annually based on the number of real property documents recorded in the previous year and the number of counties participating. Contra Costa's estimated share for FY 2100/2012 is $6,654. BACKGROUND: On November 1, 2005, the Board of Supervisors approved and authorized the Clerk-Recorder to particpate in the Electronic Recording Delivery System program and to enter into a Memorandum of Understanding with the Attorney General for oversight of the program. Weir, Clerk-Recorder Date:June 21, 2011 Contra Costa County Subject:Annual Electronic Recording Delivery System Final Intent to Participate This program allows the Contra Costa to improve BACKGROUND: (CONT'D) and modernize its systems of recording and handling real property documents by electronically receiving documents from trusted and contracted agencies. AB 578, created Government Code 27393, which requires the Attorney General to develop regulations for oversight of the California Electronic Recording Delivery Program. Government Code 27397 requires any county that establishes an elecronic recording delivery system to pay the Attorney General for the cost of regulation and oversight of the program. CONSEQUENCE OF NEGATIVE ACTION: If Contra Costa does not participate in the California Electronic Recording Delivery Program, service to residents will not progress in this electronic forum.
