APPROVE and AUTHORIZE the Health Services Director, or designee, to assign funds
from California State Department of Mental Health to the Cal-MHSA, a Joint Powers
Authority, in an aggregate amount not to exceed $3,668,800, for four years (FY 2008/09, FY
2009/10, FY 2010/11, and FY 2011/12), and to sign the MHSA PEI Statewide Projects,
Enclosure C, County Distribution Agreement for the following PEI Statewide Projects: 1)
Suicide Prevention; 2) Student Mental Health Initiative; 3) Stigma and Discrimination
Reduction.
FISCAL IMPACT:
None. These funds in the amount of $3,668,800 will be assigned to Cal-MHSA, a Joint
Powers Authority, for the three MHSA PEI Statewide Projects noted above. The Planning
Estimates for these Statewide projects are in addition to (not a part of) the original Planning
Estimates provided through Information Notice 07-19 (September 2007) that transmitted the
PEI Proposed Guidelines.
BACKGROUND:

Subject:Assignment of Funds from the State Department of Mental Health for the Mental Health Services Act for the
Assignment to Cal-MHSA,
BACKGROUND: (CONT'D)
Health Services Act (MHSA) of which was intended to “transform the public mental
health system”. The MHSA consist of six components that are being rolled out over time
by the State Department of Mental Health (DMH) with the goal of creating a better
program of mental health services and supports in California’s public mental health
systems. The six components of MHSA include: Community Planning; Community
Services and Supports (CSS); Capital Facilities and Information Technology; Workforce
Education and Training (WE&T); Prevention and Early Intervention (PEI); and
Innovation. This is a State mandated program under Welfare & Institutions Codes
In January 2007 and September 2007, the Mental Health Services Oversight and
Accountability Commission (OAC) approved five PEI Statewide Projects and
corresponding funding amounts. These Statewide Projects are also identified in the PEI
Proposed Guidelines.
In May 2008, the OAC determined that the three PEI Statewide Projects (noted in the
recommendations), would be most effectively implemented through a single
administrative entity and OAC approved a combined funding level of $40 million each
year for four years specifically for these three projects. State DMH issued DMH
Information Notice No. 08-25 in September 2008. This Info Notice laid out the purpose
of assigning MHSA-PEI funds for PEI Statewide Projects. DMH Info Notice 08-25 only
provided one option for assignment, and that was to assign all of the supplemental PEI
Statewide Assignment Funds back to the Department of Mental Health.
In November 2008, Contra Costa stakeholders recommended assignment of all four years
of PEI Statewide Project funds to State DMH to administer all four years. This
recommendation followed the required local review process, including a 30 day public
review and comment period, as well as a Public Hearing conducted by the Mental Health
Commission. In February 2009, a Board Order requesting this assignment for four years
funding was submitted for approval by the Board of Supervisors. In April 2009, the
Mental Health Director requested a hold on transmitting the assignment to DMH,
pending the release of a new DMH Information Notice, which would include more
options for assignment of these PEI Statewide funds.
In March 2010, two new DMH Information Notices were issued, which included
additional Supplemental PEI Statewide Fund Assignment options for counties to
participate in.
Contra Costa Mental Health and its stakeholders evaluated the three possible (new)
options, and thus recommends going forward with Option #1, to assign the Supplemental
PEI Statewide Assignment funds to Cal-MHSA, A Joint Powers Authority (JPA).
In August 2010, the Contra Costa County Board of Supervisors approved a Resolution to
authorize the County to join the Cal-MHSA Joint Powers Authority. Because Contra
Costa County is now a member of the Cal-MHSA JPA, it can now execute an MHSA
agreement to assign the county portion of the PEI Statewide Project Assignment funds to
the JPA. However, this agreement can only be executed via Board of Supervisor approval.
The MHSA Agreement (Provision 10) allows each County to assign funds in its Planning
Estimates for the purpose of implementing statewide MHSA programs or projects within
that component on behalf of counties, and such assignment can occur through an
assignment agreement executed between the County and one of the following: (1)
through a JPA; (2) through a multi-county collaboration; (3) through State DMH.
The draft of the revised Supplemental PEI Statewide Projects Assignment Agreement
was circulated through the local review process, including the required 30 day public
review and comment period (March 7, 2011 through April 7, 2011). A Public Hearing is
not required for this revision.
Counties will benefit directly and indirectly from these Statewide Projects through
training and technical assistance provided to Counties and their PEI partners, support for
the implementation of local PEI Projects, media and social marketing materials in
multiple languages, model program sites, enhanced state and local partnerships,
coordinated state and local efforts, research and evaluation, and statewide quality
improvement activities.
CONSEQUENCE OF NEGATIVE ACTION:
If this contract is not approved, Contra Costa County will not receive the funding to
support the PEI Statewide projects.
