RECEIVE public report of litigation settlement agreements that became final during the
period of April 21, 2011 - May 31, 2011.
FISCAL IMPACT:
Settlement amounts were paid from the sources specified below.
BACKGROUND:
One agreement to settle pending litigation, as defined in Government Code section 54956.9,
became final during the period of April 21, 2011 - May 31, 2011.
AboveNet Communications, Inc. v. California State Board of Equalization, et al.,
Sacramento Co. Sup. Ct. Case No. 34-2007-00882854-CU-CO-GDS. This was an action to
reduce the assessed value of certain telecommunication assets owned by AboveNet
Communications, Inc. for the 2003 tax year. It was agreed that the County would refund
AboveNet property

BACKGROUND: (CONT'D)
taxes and interest in the amount of $1,375. The Board of Supervisors authorized settlement
on September 21, 2010, in closed session, by a 5-0 vote. The settlement became final on
April 21, 2011. The settlement amount was paid through the Tax Trust Fund.
This report includes final settlements of litigation matters handled by the Office of the
County Counsel. This report does not include litigation settlements that were previously
reported orally in open session or by the Risk Management Division of the County
Administrator’s Office as a consent item on the Board’s open session agenda.
CONSEQUENCE OF NEGATIVE ACTION:
The report would not be accepted.
