APPROVE and AUTHORIZE the Risk Manager to execute a contract amendment
agreement with Skamser & Associates increasing the payment limit by $7,320 to $124,800
to provide assistance to the County in complying with new ADA regulations effective May,
2011. (100% Workers' Compensation Internal Service Fund)
FISCAL IMPACT:
This additional cost is funded through the Workers' Compensation Internal Service Fund.
BACKGROUND:
The Americans with Disabilities Act (ADA) provides protection against discrimination to
disabled individuals. It prohibits discrimination on the basis of disability in employment,
public services, public accommodations and requires employers to provide reasonable
accommodation to qualified disabled employees and applicants for employment.
Skamser & Associates assists the County with essential functions of job descriptions; assists
departments in

Regulations
BACKGROUND: (CONT'D)
developing and modifying essential functions for testing purposes; consults on modification
to existing policies affected by ADA and related law; trains staff on ADA related issues
including accommodation, hiring and sensitivity training; assists departments with hiring
issues related to individuals with disabilities.
Skamser & Associates also provides ongoing consultation on a case by case basis on
accommodation for existing staff with disabilities, consults and interacts with County
Counsel on litigation issues, maintains systems for the identification of employees being
provided job modification as well as assessment and response to requests for
accommodation. Skamser & Associates locates assistive devices and orders equipment;
consults with departments and the medical screening unit on accommodations, fitness for
duty and hiring procedures; and assists departments with program access issues.
Skamser and Associates will head a special project to assist the County in complying with
the new ADA laws. This new project will involve creating a new program for the new ADA
compliance within Workers' Compensation and training of the County Department ADA
coordinators on the new law for compliance.
CONSEQUENCE OF NEGATIVE ACTION:
The County will not be able to ensure compliance with the new ADA regulations which
take effect in May 2011.
