APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute a
Memorandum of Understanding between Contra Costa County and the West County
Wastewater District which would authorize Contra Costa County to provide up to $60,000
(over two years) to the District for implementation of integrated waste management
programs in the unincorporated West County area.
FISCAL IMPACT:
No impact to the General Fund. Funds to be provided pursuant to the proposed
Memorandum of Understanding (MOU) will be derived from waste and recycling collection
franchise fees paid to the Department of Conservation and Development by Richmond
Sanitary Service.
BACKGROUND:
The purpose of the proposed Memorandum of Understanding (MOU) between Contra Costa
County ("County") and the West County Wastewater District ("District") is to authorize the
use of a portion of the franchise fee revenue that the Department of Conservation and

Subject:Memorandum of Understanding between West County Wastewater District and Contra Costa County
regarding funding for integrated waste management programs
Development receives from Richmond Sanitary Service (RSS). This revenue would be used
to partially offset actual costs of implementing agreed upon waste diversion activities in the
District’s West County service area. The MOU authorizes the County to pay the District
$30,000 per year for a two year period (for a total amount of $60,000) that would begin at
the time the MOU is approved by both agencies.
These franchise fees are collected from ratepayers within the area served under the
County’s Franchise Agreement with RSS (County/RSS Franchise). RSS is the authorized
hauler of garbage in the communities of East Richmond Heights, El Sobrante, Montalvin
Manor, North Richmond, Rollingwood and Tara Hills as well as a portion of Alhambra
Valley. RSS franchise fee revenue is used by the County to cover its costs of administering
the County/RSS Franchise (including regulation of rates), implementing programs and
associated reporting to the State in order to comply with the California Integrated Waste
Management Act of 1989.
During the term of this MOU, franchise fee revenue collected by RSS will continue to be
paid directly to the County. Following approval of this MOU, the County would use
$30,000 of franchise fee revenue received from RSS each year to help offset the District’s
costs associated with implementing the agreed upon Selected Programs. The MOU requires
that the District submit reports to the County annually detailing the activities conducted and
the amount of actual expenses for each program for which the District used franchise fee
revenue.
The District would be required to limit use of County-provided RSS franchise fee revenue to
funding a proportion of costs for the Selected Programs pursuant to the terms of the MOU.
The applicable limitation on proportion of costs to be funded for each Selected Program is
specified, which takes into consideration the differences between the County/RSS franchise
service area (where fee revenue is generated) and the area served by the District (where
costs would be incurred). The majority of the District’s service area is within the cities of
Richmond, San Pablo and Pinole. Approximately one-third of the population served by the
District lives within the unincorporated area served under the County/RSS franchise.
The Selected Programs are listed below and described within Section 6 of the MOU. Some
programs are new and others have existed previously.

The MOU states that the County may change the list of Selected Programs to meet
changing State requirements following the District receiving written notice of any such
change from the County. Recognizing that the State’s integrated waste management
requirements change, the County and District agree to work together to meet changing
State requirements, adapting the programs as appropriate.
CONSEQUENCE OF NEGATIVE ACTION:
The County would not be able to pay the District for a portion of costs for the integrated
waste management programs in the unincorporated West County area.
