APPROVE and AUTHORIZE County Counsel or designee to execute, on behalf of Contra
Costa County, an agreement for specialized professional legal services with Burke,
Williams & Sorensen, LLP in connection with assigned eminent domain cases and related
matters, as recommended by the County Counsel.
FISCAL IMPACT:
Varies with services rendered in assigned cases. Services under this contract are billed at a
rate of $260 per hour for partners and $135 per hour for paralegals with future increases
subject to prior written approval by County Counsel. Eminent domain and related matters
will be charged to pertinent project accounts.
BACKGROUND:
The Public Works Department is involved in various projects in the County that may
necessitate the use of eminent domain. Benjamin Stock and J. Leah Castella, partners at

BACKGROUND: (CONT'D)
the law firm of Burke, Williams, and Sorenson, LLP, have extensive legal experience in
litigating eminent domain matters for public agencies. The Public Works Department
recommends, and County Counsel concurs, that the services of Mr. Stock and Ms. Castella
be retained for eminent domain and related purposes. The term of this contract extends
through the completion of all assigned matters.
CONSEQUENCE OF NEGATIVE ACTION:
The County would not be able to obtain legal services from this firm.
