1. APPROVE and AUTHORIZE the Conservation and Development Director to execute
required legal documents to provide a loan of $165,000 of Community Development Block
Grant (CDBG) funds to Las Trampas School, Inc (Las Trampas), a California nonprofit
public benefit corporation, for the Moraga House Rehabilitation Project in Lafayette;
2. FIND that this project is categorically exempt per Section 15301 (d) of the California
Environmental Quality Act (CEQA);
3. DIRECT the Director of Conservation and Development to file a Notice of Exemption for
the Moraga House Rehabilitation project with the County Clerk;
4. DIRECT the Director of Conservation and Development, or designee, to arrange for
payment of the $50 handling fee to the County Clerk for filing such Notice of Exemption.

Subject:Approval of Community Development Block Grant (CDBG) Program Legal Documents for Las Trampas
School, Inc.
FISCAL IMPACT:
No General Fund impact. CDBG funds are provided to the County on a formula
allocation basis through the U.S. Department of Housing and Urban Development (HUD).

BACKGROUND:
The purpose of the Moraga House Rehabilitation Project is to rehabilitate a home for
adults with severe developmental disabilities located on Moraga Boulevard in Lafayette.
On April 27, 2010, the Board of Supervisors approved $165,000 in FY 2010/11 CDBG
funds to Las Trampas, Inc for the Moraga House project. This action further implements
the 2010 action of the Board. Moraga House has three bedrooms, two bathrooms and will
serve 3 adults with severe developmental disabilities. The proposed rehabilitation
includes removal and replacement of the existing roof, removal and replacement of all
windows and doors, and interior rehabilitation to comply with the Americans with
Disabilities Act (ADA) including in the kitchen, hallways and bathrooms. All proposed
CDBG funds will be for construction costs.
The total cost of this project is $181,500. The proposed development budget and sources
of funds for this project are:

Funds will be loaned at zero percent interest for twenty years.
The County loan documents for this project will include the following (the “Loan
Documents”):
• Regulatory Agreement and Declaration of Restrictive Covenants;
• Deed of Trust with Assignment of Rents, Security Agreement and Fixture Filing;
• Promissory Note; and
• CDBG Loan Agreement
This recommended action includes authorization to execute any and all documents and to
take any and all actions necessary to implement the activities authorized under the Loan
Documents, including execution of loan amendments or modifications for the purposes of
agreeing to reasonable extensions of time deadlines for construction activities.

This project is categorical exempt from CEQA pursuant to Section 15301 (d).

CONSEQUENCE OF NEGATIVE ACTION:
If the proposed loan is not approved, the Moraga House Rehabilitation Project in
Lafayette would not be able to access the subject Community Development Block Grant
funds.
