HomeMy WebLinkAboutMINUTES - 01291985 - T.6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 29 , 1985 , by the following vote: AYES: Supervisors Powers , Schroder , McPeak , Torlakson, Fanden NOES: None ABSENT: None ABSTAIN: Norte SUBJECT: Hearing on appeal of Alhambra Valley Improvement Association from the County Planning .Commission' s decision approving Subdivision No . 6487 (Stonehurst) Ferguson & Wollman (applicant) , and California Equity Fund (owner) , in the Alhambra Valley/Martinez area. This being the time fixed for hearing on the appeal of the Alhambra Valley Improvement Association from the County Planning Commissions decision approving Subdivision No. 6487 (Stonehurst) , Ferguson & Wollman (applicant) , and California Equity Fund (owners) , to divide 238 acres in General Agricultural district (A-2) and Single Family residential District (R-40) into 47 lots , in the Alhambra Valley/Martinez area; and Harvey Bragdon , Assistant Director of Planning, advised that the Initial Study of Environmental Significance prepared for this project identified potentially significant effects on the environment , but revisions in the project plans agreed to by the applicant would avoid the effects or mitigate them to a point where clearly no significant effects would occur , and that a Negative Declaration of Environmental Significance was prepared and posted for this project on September 7, 1984; and The Chairwoman opened the public hearing and the following persons appeared: Fred A. Hackett , 100 Deodara Way, Martinez , appeared and commented that he was in opposition to the proposed project until such time as a comprehensive Environmental Impact Report is completed on this project; and Hal Olson , representing the Alhambra Valley Improvement Association, appeared and also commented that a complete Environmental Impact report was needed for this project before a decision is made; and Richard Loewke , representing the City of Martinez , appeared and commented on the issues of water supply, annexation, drainage requirements , and traffic concerns related to this project; and Robert Rhoades , 2010 Geary Road , Pleasant Hill , repre- senting the Consolidated Fire District , appeared and presented the Board with information with respect to Fire Protection Services for the proposed project; and William Beeman, 5085 Alhambra Valley Road , Martinez, appeared and requested that the Board require a complete Environmental Impact Report before making any decision on this project; and Ruth Newman , 127 Sheridan Lane , Martinez , appeared and requested an Environmental Impact Report; and E . Donley Gray, 41 Milthwait Drive , Martinez , appeared and commented on the need for an Environmental Impact Report before a decision is made on this project; and Stuart Safine , attorney, representing the owner and appli- cant , appeared and commented that an Environmental Impact Report for this property was previously prepared for a similar type of development , and stated that there has been a tremendous lessening of the impacts for this project because of the reduction in density, .and stated that he felt this project adequately met the County require- ments , stating that it was in compliance with the zoning and the General Plan, and urged the Board to approve Subdivision No. 6487 in the Alhambra Valley/Martinez area; and The Chairwoman closed the public hearing, as there was no one else desiring to speak; and Supervisor Fanden commented that she would like to have at least a week to further study this proposal and commented that she would like to see a further study done especially in the areas of traffic mitigation, and commented that she would like the Planning staff to look into the concerns which have been raised by some of the residents in the community, and also stated that unless some of these concerns could be adequately addressed she would request a complete Environmental Impact Report on this project; and Supervisor Powers inquired as to whether there was a con- dition in the development plan which would require a contribution to the Fire Station; and Harvey Bragdon advised that there is a condition that the developer provide a fire station site on this property or pay a pro rata share of $45,496 if the station site is deleted; and Supervisor Fanden recommended that the Board refer the questions raised at this hearing back to staff for approximately two weeks and make a decision on this subdivision after receiving a report back; and Victor Westman , County Counsel , advised that once the public hearing has been closed a decision is required within 10 days; and Supervisor Fanden recommended that the public hearing remain open and that this matter be continued to February 12, 19859 at 2: 30 p.m. Board members considered the matter , IT IS ORDERED that the recommendation of Supervisor Fanden is APPROVED. 1 hem.t-y certl,.y 11,al this:s s true end aonecteopy of an action taken and en'-.rad on the minutes of jhe Board of Super�ria rs on the date shovaL ATTESTED: ,2 q 1y�5 PHI. 8AT HELCR,dierk of the Board Ori g Dept: Clerk of the Board of Supenrtsors and County Alminlstnfor cc: Director of Planning Public Works Director County Counsel By Deputy Ferguson & Wollman California Equity Fund 2 K/
