APPROVE and AUTHORIZE the Chief Engineer, Contra Costa County Flood Control and
Water Conservation District (District), or designee, to execute an Encroachment Permit
issued by the City of Lafayette (City) to the District for the Lafayette Creek Easement
Restoration Project, Lafayette area. (100% Flood Control Zone 3B Funds)
FISCAL IMPACT:
The project cost estimate is $56,000 and will be 100% funded by Flood Control Zone 3B
funds. The City of Lafayette will waive the permit fee.
BACKGROUND:
The Lafayette Creek Easement Restoration Project consists of routine maintenance work
within the District's easement along the Lafayette Creek concrete channel between Moraga
Road and 3rd Street in the City.
The encroachment permit will allow the District to occupy the road shoulder at 1st and 2nd
Streets in the City in order to access the channel through the District's gates.

The City's encroachment permit application requires the

District to sign indemnification language that requires the District to indemnify, defend,
and hold harmless the City from any damages or liabilities resulting from the District's
occupation of the road shoulder during the performance of the work.
CONSEQUENCE OF NEGATIVE ACTION:
The District will be unable to complete the Lafayette Creek Easement Restoration Project
at 1st and 2nd Streets along the channel.
