REFER to the Public Protection Committee the matter of civil gang injunctions, as
requested by the District Attorney.
FISCAL IMPACT:
None.
BACKGROUND:
In 2009, it was estimated that over one million gang members resided in the United States.
The average gang member first joins a gang at the age of 12 ½.
The District Attorney is interested in establishing a County practice of obtaining civil gang
injunctions against all known violent gang members in Contra Costa County. A civil gang
injunction is a court-issued restraining order prohibiting gang members from participating in
certain activities. It is based on the legal theory that gang activity constitutes a public
nuisance that prevents non-gang members and ordinary residents from enjoying peace in

attributed to the use of gang injunctions.
CONSEQUENCE OF NEGATIVE ACTION:
CHILDREN'S IMPACT STATEMENT:
The Committee referral supports four of the five community outcomes identified by the
Board of Supervisors that place a priority on children's services: (1) Children Ready for and
Succeeding in School; (2) Children and Youth Healthy and Preparing for Productive
Adulthood; (4) Families that are Safe, Stable and Nurturing; and (5) Communities that are
Safe and Provide a High Quality of Life for Children and Families.
