HomeMy WebLinkAboutMINUTES - 04122011 - C.01RECOMMENDATION(S): APPROVE the Right of Way Contract and ACCEPT the Grant of Easement from East Bay Municipal Utility District (EBMUD) for property rights needed in connection with the Alhambra Valley Road Safety and Bicycle Improvement Project (Project). APPROVE the conveyance of a Quitclaim Deed to EBMUD for property rights no longer needed for road purposes pursuant to Government Code Section 25526.5 and AUTHORIZE the Chair, Board of Supervisors, to execute said Quitclaim Deed on behalf of Contra Costa County (County). AUTHORIZE the Public Works Director, or designee, to execute said Right of Way Contract on behalf of the County. AUTHORIZE the Auditor-Controller to issue a check in the amount of $1,000 payable to East Bay Municipal Utility District, c/o Real Estate Services, P.O. Box 24055, Oakland, CA 94623 as processing fee for said property rights and any other considerations set forth in the Right of Way Contract. (District II) (Federal Project No.: HRRR-5928(083) Project No.: 0662-6R4095 DIRECT the Real Property Division of the Public Works Department to deliver a certified copy of this Board Order and Quitclaim Deed to EBMUD for acceptance and recording in the office RECOMMENDATION(S): (CONT'D) of the County Recorder and DIRECT the Real Property Division to have said Grant of Easement recorded in the Office of the County Recorder. FISCAL IMPACT: The project cost estimate is $1,982,000 and will be funded by Proposition 1B (55%) and the Federal High Risk Rural Road (HRRR) program (45%). BACKGROUND: This section of Alhambra Valley Road is a narrow two-lane road that has tight turning radius and very little shoulder area for drivers to recover when vehicles veer off the road. The design of this rural road was not intended to accommodate the speed of travel or volume that exists today. The Project will not cause an increase in traffic or encourage changes to existing land use patterns; therefore, no new vehicle trips are expected to occur. The purpose of the Project is to realign an approximate 1,200-foot long section of Alhambra Valley Road beginning approximately 4,600 feet east of Castro Ranch Road to provide shoulder and clear recovery areas for motorists should their vehicle veer off the traveled way and meet the design standards for a Class III bicycle route. The majority of the work will take place on the north side of the road with minor realignment and soil stabilization improvements occurring on the south side of the road. In addition, the current storm water drainage with an existing 12-inch diameter culvert pipe will be replaced with an 18-inch diameter culvert pipe and rock slope protection will be placed around the culvert outfall to prevent erosion. The County will quitclaim back to EBMUD the right of way no longer necessary for road purposes within the Project area. EBMUD is requiring the County to indemnify them as a condition for the grant of easement. CONSEQUENCE OF NEGATIVE ACTION: The County will not have sufficient land rights to complete the roadway and drainage improvements according to the approved plans and specifications and would end up with land no longer necessary.
