FIND the Bay Area-Wide Trash Capture Project is a California Environmental Quality Act (CEQA), Class 2(c)
Categorical Exemption, pursuant to Section 15302(c) of the CEQA Guidelines [DCD-CP#11-22] Project No.:
7517-6W7078, and
DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk, and
AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to the Department of Conservation and
Development for processing, and a $50 fee to the County Clerk for filing the Notice of Exemption.
FISCAL IMPACT:
This project is funded by the Bay Area-Wide Trash Capture Demonstration Project Grant Fund (100%). This action
will necessitate payment of a $25 fee to the Department of Conservation and Development for processing, and a $50
fee to the County Clerk for filing the Notice of Exemption.

BACKGROUND:
This project is necessary to comply with the County’s Municipal Separate Storm Sewer System (MS4) National
Pollutant Discharge Elimination System (NPDES) permit to reduce trash from entering receiving waters. Contra
Costa County is regulated by two Municipal Separate Storm Sewer System (MS4) National Pollutant Discharge
Elimination System (NPDES) Permits, issued by the Central Valley Regional Water Quality Control Board and the
San Francisco Bay Regional Water Quality Control Board.
Recent re-issuances of the County’s MS4 NPDES permits require the County to take actions to reduce the load of
trash conveyed by its MS4 system into receiving waters. Among specific requirements is a mandate to install
structural Full Trash Capture Devices (FTCDs) designed to remove trash particles 5 millimeters in diameter and
larger from stormwater (i.e., catch basin inserts and in-line devices). FTCDs must be installed in the County’s storm
drain system in locations with tributary areas of at least 30% of the County’s total “Commercial Retail Wholesale”
land area, as defined by the Association of Bay Area Governments’ 2005 Existing Land Use Data. This amounts to
157 acres of land from which runoff must be routed to FTCDs.
In order to facilitate the implementation of FTCDs, help defray the costs to local governments associated with trash
capture requirements, and allow the local governments to gain experience with specific FTCDs prior to committing
their own funds for implementation of these devices, the San Francisco Estuary Project in conjunction with the San
Francisco Bay Regional Water Quality Control Board, applied for a grant to distribute funds to municipalities so that
they may implement demonstration FTCD projects.
Under the Bay Area-Wide Trash Capture Demonstration Project, Contra Costa County has been preliminarily
awarded funds to implement this pilot program. All FTCDs will be installed in existing infrastructure with adequate
access. The project will not require relocation of other utilities, signs, structures, etc. and is not expected to require
lengthy road lane closures.
The County intends to install FTCDs in existing storm drain facilities within areas where the County already has full
rights to do so (i.e., fee title ownership or existing easements) therefore, the project will not require acquisition of
any right-of-way or easements.
CONSEQUENCE OF NEGATIVE ACTION:
Delay in approving the project will result in compromising the County’s ability to implement the demonstration
project and gather required data in compliance of the NPDES permit.
