HomeMy WebLinkAboutRESOLUTIONS - 02271990 - 90/123THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on February 27, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION N0, 90/123 SUBJECT: Approval of a Substitute Subdivision Agreement, ! Subdivision MS 93-86, Alamo Area. The following document was presented for Board approval this date: A substitute Subdivision Agreement with Smith Land and Development Company, subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said document was accompanied by the following: Security to guarantee the road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: a. Cash deposit (Auditor's Deposit Permit No. 168775, dated February 9, 1990) in the amount of $1, 000 made by Smith Land and Development Company. b. Additional security in the form of a cash deposit Auditor's Deposit Permit No. 168775, dated February 9, 1990) in the amount of $27,500, 18, 000 for faithful performance and $9,500 for labor and materials) made by Smith Land Development Company. NOW THEREFORE BE IT RESOLVED that said substitute Subdivision Agreement is APPROVED. BE IT FURTHER RESOLVED that the Subdivision Agreement with California Redwood Homes Incorporated, as approved by the Board on February 23, 1988, is TERMINATED, the improvement security bond with Indemnity Company of California is EXONERATED and the Public Works Director is AUTHORIZED to refund the cash deposit Auditor's Deposit Permit No. 134831, dated January 15, 1988) in the amount of $1, 000, plus interest in accordance with Government Code Section 53079, if appropriate, to California redwood Homes Incorporated.
