HomeMy WebLinkAboutMINUTES - 03222011 - C.51RECOMMENDATION(S): As the Governing Board of the Contra Costa County Redevelopment Agency APPROVE and AUTHORIZE the Redevelopment Director to execute a Project Agreement and Work Program with Contra Costa County for the North Richmond Industrial Area Infrastructure Program in the amount of $3.9 million with an effective date of September 27, 2010. FISCAL IMPACT: The project budget is $3.9 million, of which $3.0 million is Redevelopment Agency funding. No General Funds would be utilized. All funds are budgeted under the North Richmond Redevelopment Project Area for FY 2010 -2011. Infrastructure challenges include, among other items: deteriorating roadways, inadequate water transmission and wastewater facilities, storm water management, and inadequate drainage. The purpose of this Agreement is to initiate a comprehensive area-wide infrastructure improvement plan for the industrial area north of Parr Boulevard. The goal is to undertake an infrastructure upgrade program to address deficiencies and prepare the employment area for redevelopment and job creation. The Work Program involves planning, design, and construction of infrastructure improvements in the industrial area. The work scope of this Project Agreement is comprised of two phases-an initial phase to affirm previous findings, analyze current infrastructure needs, provide cost estimates, identify CEQA/NEPA requirements, project schedule, and other pertinent data necessary to identify a first phase for construction, and a second phase of completing construction of priority infrastructure improvement elements for these employment generating uses consistent with available budget. The outcome of this Agreement will result in a supplemental Work Program to specifically address the most acute deficiencies in the area. These findings will become the roadmap to final design and construction of the improvements. This plan will also compliment infrastructure work already underway in the North Richmond Specific Plan area, and help gage the level of community/property owner support for participation in a public-private partnership to finance additional improvements above the budgeted threshold below. The Project Agreement has a total expenditure amount of $3.9 million which is comprised of $3 million in Redevelopment Agency Bond proceeds and $900,000 in North Richmond Area of Benefit funds. The attached agreement allocates the $3.9 million as follows: $226,750 on the Planning Phase, and $3,672,250 on the Implementation Phase which includes actual construction of the improvements. Health & Safety Code Section 33445 Findings: Pursuant to California Redevelopment Law, the Agency may fund public improvements owned by another public agency with the consent of the Board of Supervisors, and if the Board of Supervisors finds and determines that: 1) the public improvement will be of benefit to the project area; 2) no other reasonable means of financing the public improvement is available to the community; and 3) the public will assist in the elimination of one or more blighting conditions inside the project area; and 4) Agency assistance for the public improvement is consistent with the Agency’s current Implementation Plan (Section 33445 of the Health & Safety Code) The County Public Works Department has conducted an analysis of its financial capability to fund the activities contemplated by the Project Agreement. Due to the limited availability of general funds, the lack of adequate funds in local developer fee accounts, the State’s budget crisis, and the County Public Works funding priorities, the County Public Works Department does not currently have sufficient funds to pay for the costs of the design and construction of the infrastructure improvements. Redevelopment’s funding of the North Richmond Industrial Area Infrastructure Program will assist in the revitilization of the area by addressing one of the major conditions of blight--the lack of adequate infrastructure including roads, drainage, and flood control improvements. The improvements will support revitalization efforts already underway by local organizations like North Richmond Green, and the North Richmond Waste & Recovery Mitigation Committee. Their joint mission is to remove blight and combat code enforcement issues throughout the project area. However more importantly, implementation of this Program will serve as a catalyst for the industrial area, generate private investment dollars, and create jobs for the local populace. This Project Agreement is identified in and consistent with the priorities established by the North Richmond Municipal Advisory Council and from the Agency’s 2010-2015, AB 1290 Implementation Plan. CONSEQUENCE OF NEGATIVE ACTION: If the project is not approved, the infrastructure north of Parr Boulevard will continue to deteriorate and the employment generating area will not be positioned to redevelop.
