ADOPT a position of "Support" for AB 147 and AUTHORIZE the Chair to sign the
attached letter, as recommended by the Transportation, Water and Infrastructure
Committee.
FISCAL IMPACT:
NONE from the recommended action. If the bill becomes law, it will broaden the types of
transportation improvements that can be financed through the County's existing impact
mitigation fee programs.
BACKGROUND:
The Transportation, Water and Infrastructure Committee on February 28 reviewed AB 147
and recommended the Board adopt a position of support along with a potential amendment.
The bill was initiated by Contra Costa County as part of its 2011 State Legislative Platform.
At our request, CSAC made the bill part of its own platform. CSAC then worked with
Assembly member Roger Dickinson of Sacramento to introduce the bill. AB 147 is now
with the Local Government Committee of the Assembly.

BACKGROUND: (CONT'D)
The bill would broaden the types of transportation improvements that could be funded
with revenue from traffic impact mitigation fees (one-time fees charged on new
development). Current law restricts the fee revenues to be used only for improvements to
“bridges and major thoroughfares.” AB 147, if approved, would allow these revenues to
be used for any type of transportation improvement that is needed to mitigate the impacts
of growth, including transit facilities such as bus stops, shelters, or bus turnouts;
pedestrian ways; bikeways; and traffic-calming facilities. Bridges and major
thoroughfares also would remain as eligible uses.
Bridge and thoroughfare improvements are often needed to support development in
newly developing areas. In older areas of the County that are already built out, where
infill development is occurring, there may not be room or opportunity to widen roads or
build new roads or bridges. In these areas, the transportation impacts of development
must be accommodated through other means, such as transit facilities, or pedestrian and
bicycle connections to transit stops, for example.
AB 147 would allow the County to use impact mitigation fee revenues for these types of
improvements, by amending a portion of the Subdivision Map Act, which is the statute
that authorizes cities and counties to have impact mitigation fee programs.
The Transportation, Water and Infrastructure Committee recommends the Board adopt a
position of "support" for this County-initiated bill. The Committee also recommends the
County include comments, perhaps as an amendment to the bill, regarding a local
agency's ability to prioritize among the various improvements to be funded through
impact fee programs. This is reflected in the attached proposed letter for the Chair's
signature.
Also attached is the full text of AB 147.
CONSEQUENCE OF NEGATIVE ACTION:
The author of the bill will not know the County supports his legislative effort, which was
developed at the County's initiative.
