APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute the First
Amendment to the Funding Agreement between the Contra Costa County Flood Control &
Water Conservation District and American Rivers, Inc., to increase funding by $30,000 to a
new payment limit of $130,000 for construction costs of the Marsh Creek Fish Passage
Improvement Project, Brentwood area.
FISCAL IMPACT:
There is no fiscal impact to the General Fund. This project is funded by Flood Control Zone
1 Funds. The Flood Control District has applied for, and expects to receive, State Prop 50
grant funds through the East County Integrated Regional Management Plan to offset the
Flood Control Zone 1 Funds expended for this project.
BACKGROUND:
The Flood Control District previously entered into a Funding Agreement to cover a portion
($100,000) of the costs for American Rivers to plan, design, and construct a fish ladder
within the existing drop structure in Marsh Creek to improve fish passage. American Rivers

BACKGROUND: (CONT'D)
received several grants for this work. However, the funding received did not adequately
cover the construction costs based on the low bid. In addition, construction costs
increased due to changed field conditions and additional construction management. To
cover these cost increases, it is necessary to amend the Funding Agreement to provide up
to $30,000 in additional funding.
Pursuant to the Funding Agreement, American Rivers has completed construction of the
fish ladder improvement, and the Flood Control District will soon accept the fish ladder
for maintenance. Following project acceptance and receipt of a final invoice, the Flood
Control District will reimburse American Rivers for eligible costs listed in the agreement.
The proposed amendment would authorize the Flood Control District to reimburse
American Rivers for not to exceed $130,000 in eligible project costs.
CONSEQUENCE OF NEGATIVE ACTION:
If the amendment is not approved, there will not be adequate funding for the fish ladder
project, and some grant funds could potentially be lost.
