HomeMy WebLinkAboutMINUTES - 03222011 - C.08RECOMMENDATION(S): APPROVE and AUTHORIZE the Chief Engineer, Flood Control and Water Conservation District, or designee, to execute Amendment No. 1 to the Consulting Services Agreement with GEI Consultants, Inc. (GEI) for work on the Upper Sand Creek Basin Expansion. Amendment 1 increases the payment limit by $110,500 to a new payment limit of $1,011,787 and changes the completion date from January 11, 2011, to May 31, 2012. FISCAL IMPACT: The action will result in an increase of $110,500 to the payment limit and will be funded by Drainage Area 130 developer impact fees. BACKGROUND: The existing Consulting Services Agreement for geotechnical engineering provides the Contra Costa County Flood Control and Water Conservation District (FC District) with professional services for the analysis, design, and state regulatory coordination, to ensure dam stability of the future Upper Sand Creek Detention Basin, located within the City of Antioch in the Marsh Creek Watershed. (100% Drainage Area 130 Funds) Project No. 7562-6D8518 BACKGROUND: (CONT'D) included in the DA 104/Zone 1 plan and fee structure, approved in 1992. Construction of the ultimate basin will protect downstream areas of Antioch, Brentwood, and Oakley from flooding, as well as mitigate the impact of development in Eastern Contra Costa County. The California State Department of Water Resources, Division of Safety of Dams (DSOD) requires a detailed study and report on site geology, dam foundation design, and construction. The engineering capabilities required to investigate the site, to prepare plans, specifications, and cost estimates for contract advertising, and to inspect the construction work is beyond the capability of the FC District staff. The amendment to the payment limit and completion date is due to overall project delays caused by additional requirements imposed by DSOD and the U.S. Army Corps of Engineers. In June of 1992, the Board approved the Environmental Impact Report for the Marsh Creek Watershed Regional Drainage Plan, of which the Upper Sand Creek Basin is a component, in compliance with CEQA. On November 3, 2010, the Board of Supervisors approved a project-specific mitigated negative declaration concerning this project. CONSEQUENCE OF NEGATIVE ACTION: Without the Board of Supervisors’ approval, the primary flood protection infrastructure planned for Marsh Creek Watershed will be delayed. In addition, the significant time and resources expended by staff and the Consultant to complete the project design would be lost. CHILDREN'S IMPACT STATEMENT: Not applicable.
