HomeMy WebLinkAboutMINUTES - 03222011 - C.04RECOMMENDATION(S): APPROVE and AUTHORIZE the Chief Engineer, Flood Control and Water Conservation District, or designee, on behalf of the Contra Costa Clean Water Program, to execute a contract amendment with Dan Cloak Environmental Consulting to increase the payment limit by $50,000 from $100,000 to an amount not to exceed $150,000, for National Pollutant Discharge Elimination System (NPDES) technical support, effective February 1, 2011. (100% Cities and County Stormwater Utility Fee Assessmemts) Countywide Project No. 7519-6X7645 FISCAL IMPACT: The cost is estimated to be $50,000 and shall be funded by stormwater utility fee assessments collected by the cities and county, proportioned to their respective population. BACKGROUND: At the current level of C.3 consultant support services being provided to the Program, the $100,000 budget will be exhausted by February 1, 2011. Bueren, Public Works Director/Chief Engineer Date:March 22, 2011 Contra Costa County Subject:Amend Dan Cloak Environmental Consulting contract to increase the payment limit to $150,000, effective February 1, 2011 through June 30, 2011 BACKGROUND: (CONT'D) First was the protracted time and effort involved with the successful negotiations with the Central Valley Regional Water Quality Control Board (and the San Francisco Bay Regional Water Quality Control Board) for reissuance of the East County NPDES Permit. The protracted negotiations coupled with the reduction in staffing required a greater than anticipated level of consultant support. Second, the unanticipated level of technical support needed to initiate, plan, and review the first HMP monitoring site. Third, staff did not fully anticipate the time commitment, complexity, and the scope of C.3 projects that have been undertaken regionally. CONSEQUENCE OF NEGATIVE ACTION: If the contract with Dan Cloak Environmental Consulting is not amended, the contractor will not be able to provide services beyond the month of February, 2011 and all municipalities may be in non-compliance with the Joint Municipal NPDES permits issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards. Potentially, fines totaling $10,000 per day and $10 per gallon of stormwater discharge for all affected entities could be imposed. CHILDREN'S IMPACT STATEMENT: Not Applicable.
