APPROVE the conveyance of surplus real property to Michael Sitzman and Renée Sitzman,
trustees UDT 2/7/03, pursuant to Government Code Section 25526.5.
DETERMINE that the project is exempt from the requirements of the California
Environmental Quality Act (CEQA) as a Class 12 Categorical Exemption under County
Guidelines and Section 15312 of the State CEQA Guidelines, and DIRECT the Director of
the Department of Conservation and Development (DCD) to file a Notice of Exemption
with the County Clerk and DIRECT the Public Works Director to arrange for payment of a
$50.00 handling fee to the County Clerk for filing and a $25.00 fee to DCD for processing
of the Notice of Exemption.
DETERMINE that said property to be surplus and no longer necessary for county or other
public purposes, and its’ estimated value does not exceed twenty-five thousand dollars
($25,000).
AUTHORIZE the Chair, Board of Supervisors, to execute a Grant Deed on behalf of the
County in consideration for the payment received in full in the amount of $15,000.

FISCAL IMPACT:
The County received $15,000 in applicant fees for this action to cover administrative
costs.
BACKGROUND:
Contra Costa County (County) acquired the real property on June 27, 1963 in the City of
Lafayette, described in Exhibit "A" attached hereto, for a proposed roadway realignment
of Acalanes Road. The realignment was never constructed.
CONSEQUENCE OF NEGATIVE ACTION:
The County may be responsible for the maintenance of these areas.
CHILDREN'S IMPACT STATEMENT:
Not applicable.
