APPROVE the Routine Maintenance Activities under California Department of Fish and
Game (CDFG) Routine Maintenance Agreement (RMA) Project [DCD-CP#11-07] Project
No.: 7505-6F8231, and
FIND the project is a California Environmental Quality Act (CEQA), Class 1 and 4
Categorical Exemption, pursuant to Article 19, Section 15301(1) (d) and Section 15304 of
the CEQA Guidelines, and
DIRECT the Director of Conservation and Development to file a Notice of Exemption with
the County Clerk, and
AUTHORIZE the Chief Engineer/Public Works Director, or designee, to arrange for
payment of a $25 fee to Conservation and Development for processing, and a $50 fee to the
County Clerk for filing the Notice of Exemption.

Subject:APPROVE the Routine Maintenance Activities under CDFG Routine Maintenance Agreement Project and
make related findings under the CEQA, Countywide
FISCAL IMPACT:
The maintenance activities performed under this RMA will be funded by Flood Control
District funds, drainage area benefit assessments, stormwater utility fees, and road funds.
The new requirements in this RMA will cause a slight increase in the costs to perform
routine maintenance activities, however, the costs incurred will be much less than
obtaining multiple permits for the various type of activities regulated by the Fish and
Game Code. Obtaining this RMA is the most efficient way to have routine maintenance
activities permitted by Fish and Game.
BACKGROUND:
The Contra Costa County Public Works Department (PWD) and Flood Control and
Water Conservation District (FCWCD) propose to conduct routine maintenance activities
including: sediment and debris removal from within channels and around facilities such
as bridges, culverts and trash racks; vegetation management including mowing, trimming
with hand-held tools, and application of herbicides; maintenance, repair, rehabilitation,
and replacement of existing structures; bank stabilization activities; and temporary water
diversion necessary to complete these routine maintenance activities. These activities will
be covered by the California Department of Fish and Game under a Routine Maintenance
Agreement under Section 1602 of the Fish and Game Code. The activities proposed for
coverage under the RMA consist of routine maintenance activities that pose minimal
threat to water quality and beneficial uses of the creeks within the County when
appropriate Best Management Practices (BMPs) are implemented. BMPs will be
activity-specific and include measures such as dewatering the work zone, timing the
activities to avoid impacts, fueling and maintaining equipment outside of the stream
zone, seeding exposed areas, installing erosion control blankets, isolating freshly poured
concrete from flowing water for at least 28 days, applying herbicides in no or low-wind
conditions, and conducting nesting bird surveys if tree removal will occur between
February 15 and August 31. In order to ensure no impacts to listed species,
preconstruction surveys will be conducted in areas of known or suspected listed species
habitat. If listed species are identified during these preconstruction surveys or during the
maintenance activity, work will be immediately terminated and DFG contacted.
Maintenance activities conducted under the RMA will be conducted only on an as-needed
basis and will be limited in nature to those activities necessary to ensure continued
effective operation of the County’s flood control and road facilities. Real property
transactions may be necessary in support of these routine maintenance activities.
CONSEQUENCE OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of maintenance activities and could
create an unacceptable risk of flood and fire damage Countywide.
