Approve and authorize the Health Services Director, or his designee (Donna Wigand), to
execute, on behalf of the County, as follows:
1. Cancellation Agreement #24-403-8 with Jon Whalen, M.D., a self-employed individual,
effective on the close of business on January 31, 2011; and
2. Contract #24-403-9 with Jon Whalen, M.D., a self-employed individual, in an amount not
to exceed $300,800 for the provision of professional psychiatry services to minors, for the
period from February 1, 2011 through January 31, 2012.
FISCAL IMPACT:
This Contract is funded by 50% Federal Medi-Cal and 50% State early and Periodic
Screening, Diagnosis and Treatment (EPSDT) Funds.

Subject:Cancellation Agreement #24-403-8 and Contract #24-403-9 with Jon Whalen, M.D.
BACKGROUND:
In October 2010 the County Administrator approved and the Purchasing Services Manager
executed Contract #24-403-7 with Jon Whalen, M.D., to provide psychiatric services to
minors at the East County Children’s Clinic, for the period from February 1, 2011 through
January 31, 2012.
In consideration of Contractor’s agreement to continue providing services and to provide
additional services, both parties have agreed to re-negotiate payment terms. The Department
and the Contractor have mutually agreed to renegotiate the Contract Payment Provisions
and the term to reflect the intent of the parties. Therefore, in accordance with General
Conditions, Paragraph 5. (Termination and Cancellation) of the Contract, the Department
and Contractor have agreed to a mutual cancellation of Contract #24-403-7. Approval of
Cancellation Agreement #24-403-8 will accomplish this termination.
Under Contract #24-403-9, Contractor will provide professional psychiatric services to
minors, through January 31, 2012.
CONSEQUENCE OF NEGATIVE ACTION:
If this contract is not approved, minors requiring these psychiatric services at East County
Children’s Clinic would go untreated.
