HomeMy WebLinkAboutMINUTES - 01252011 - C.07RECOMMENDATION(S): ADOPT Resolution No. 2011/33 accepting completion of warranty period and release of cash deposit for faithful performance and accepting maintenance access easement, subdivision SD 04-08939, as recommended by the Public Works Director, Walnut Creek area. (District III) FISCAL IMPACT: No Fiscal Impact. BACKGROUND: The public and private road improvements have met the guarantee performance standards for the warranty period following completion and acceptance of the improvements. The Maintenance Access Easement is necessary to allow the County legal access through the subdivision to a flood control facility. CONSEQUENCE OF NEGATIVE ACTION: The developer will not receive a refund of their cash deposit, the Subdivision Agreement and performance/maintenance surety bond will not be exonerated, and the billing account will not be liquidated and closed. If the Maintenance Access Easement is not accepted, the County will not have legal access through the subdivision to maintain the flood control facility.
