APPROVE and AUTHORIZE the Chair, Board of Supervisors ,to execute the License Agreement with United States
of America – Military Ocean Terminal, Concord (MOTCO), effective August 10, 2010 through August 10, 2029, for
the purpose of installation and maintenance of a rain gauge monitor and related equipment, Concord area (District
IV).
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The Contra Costa Flood Control and Water Conservation District (District) monitors the collection of rain and stream
gauge data, which also includes maintenance of rain and stream gauges throughout Contra Costa County. The
location of MOTCO’s property is an ideal location for installation of the monitoring equipment. As one of the
conditions of the license agreement, MOTCO is requiring indemnification language. In July 2010 the agreement was
sent to MOTCO but was not returned executed to District until November 2010. The rain gauge equipment will be
installed upon approval by the Board of Supervisors.

CONSEQUENCE OF NEGATIVE ACTION:
If the license agreement is not approved, the District will be unable to install the rain gauge equipment, which will
