APPROVE a revenue Sublease with Seneca Center for the County leased premises at 1034 Oak Grove Road, Concord, for an eight (8) month term beginning November 1, 2010, and ending June 30, 2011, at a rent of $24,000 per month for approximately 10,611 square feet of psychiatric residential care space, and 2,400 square feet of classroom and office space under the terms and conditions set forth in the revenue Sublease. 2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the revenue Sublease. 3. DETERMINE the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#10-57; WLP697). 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption. Lango, General Services Director Date:December 14, 2010 Contra Costa County Subject:Approve and Authorize a Revenue Sublease with Seneca Center for the Premises at 1034 Oak Grove Road, Concord for the Health Services Department FISCAL IMPACT: The County will receive revenue of $192,000 over the eight (8) month term of the Sublease. Thereafter, the County will receive revenue of $288,000 per year if the Sublease is renewed with Seneca Center. The County pays approximately $310,000 in annual rent payments under the Facility Lease for the property. Revenue and rent payments are budgeted in the Health Services Department 2010/2011 Budget. BACKGROUND: On March 1, 2000, the County entered into a 20-year Facility Lease with Transocean Financing Corporation (Lessor) for the leased premises. The Facility Lease provides that the County can either purchase the building prior to the expiration date by paying the remaining balance of rents, or title to the premises will transfer to the County upon the expiration of the Facility Lease. In July 2001, the County Health Services Department entered into a Sublease with Seneca Center (Seneca), a non-profit mental health care provider, and a Program Service Contract with Seneca for them to provide residential psychiatric mental health treatment services from the premises. The new Sublease is for an eight month term, and provides for automatic one-year renewals subject to the Health Services Department renewing its Program Service Contract with Seneca. The new Sublease increases the revenue to the County by $12,000 annually. CONSEQUENCE OF NEGATIVE ACTION: If the revenue Sublease is not approved, the County will not receive the revenue under the Sublease to offset its lease payments, and other arrangements will have to be made to provide mental health services in the area as needed.
