Holcombe (address on file) to the Contra Costa County Employees' Retirement Association Board of Trustees to fill a vacancy in Seat #9 and to serve for the remainder of the term, to expire on June 30, 2011, as recommended by the Internal Operations Committee; and DECLARE vacant the Board of Supervisors' Alternate seat on the Contra Costa County Employees Retirement Board, held by Jerry R. Holcombe; and DIRECT the Clerk of the Board to post the vacancy. FISCAL IMPACT: No fiscal impact to the County from this action. BACKGROUND: On December 12, 2000, the Board of Supervisors approved a policy on the process for recruiting applicants for selected advisory bodies of the Board. This policy requires an open recruitment for all vacancies to At Large seats appointed by the Board. On October 13, 2010, Mr. Paul Katz passed away, leaving a vacancy for Seat #9 on the Contra Costa County Employees Retirement Board. By Board of Supervisors resolution, if there is a vacancy with respect to the 4th, 5th, 6th, or 9th seat, the Alternate member shall fill that vacancy until the Board of Supervisors appoints a regular member. This process is also established in statute (County Employees Retirement Law of 1937, Sec. 31520.12), which states: "If there is a vacancy with respect to the fourth, fifth, sixth, or ninth member, the alternate member shall fill that vacancy until a successor qualifies." On October 26, 2010 the Board of Supervisors declared a vacancy for Seat #9 and directed the Clerk of the Board to post the vacancy. As a result of the recruitment, three applications were received and determined to be eligible for consideration. The Internal Operations Committee interviewed the three candidates on December 6, 2010. Prior to the interviews, each candidate was advised of the significant time commitment required of Retirement Board members and of the important of disclosing any conflicts of interest. Each candidate assured the committee that he could fulfill his responsibilities if appointed and was aware of no conflicts of interest. As a result of the interviews, the Committee recommends the appointment of Jerry R. Holcombe, the current Alternate to seats 4, 5, 6, and 9 on the Board of Trustees. The IO Committee also recommends the initiation of the recruitment process to fill the Alternate vacancy that would be created by Mr. Holcombe's appointment. The IO Committee was most appreciative of the time and interest of the applicants. CONSEQUENCE OF NEGATIVE ACTION: If this appointment is not made to the Retirement Board, the County will not be fully represented on the Board of Trustees. CHILDREN'S IMPACT STATEMENT: None.
