APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute a contract with
Elections Systems and Software (ES & S) for an amount not exceed $592,939 for hardware
maintenance, software maintenance and support for the period January 1, 2011 through
December 31, 2012. This amount does not include funding for two optional two-year
renewal periods (2013-2014) and (2015-2016).
FISCAL IMPACT:
The initial two years of the contract will be funded with unanticipated revenues from the
State for reimbursement of costs associated with the May 19, 2009 special election. Cost of
the extensions will be general fund expenditures.
BACKGROUND:
Due to the Federal Help America Vote Act (HAVA) of 2002, Contra Costa is required to
have a voting system in place that allows all voters with physical and/or visual disabilities to
vote confidentially and unassisted. The Board of Supervisors approved the purchase,
licensing and support of such a voting system on January 11, 2005. The contract included

licensing and maintenance for 5 years, which expires December 31, 2010. Licensing,
maintenance and support is required for the system.
CONSEQUENCE OF NEGATIVE ACTION:
Licensing is required to use the vote tally system. Without it, Contra Costa will not be
able to count ballots. Without maintenance and support, the voting system will not be
maintained as required and Contra Costa may not meet Federal mandates for accessibility
and language requirements. We are not able to contract with outside maintenance
contractors, as it will void our contract warranties, which could require expensive
equipment replacement.
