Subject:Agreement #10-0738 LBAM Regulatory Services
BACKGROUND: (CONT'D)
a Federal Domestic Quarantine Order (DA-2007-42), regulating the interstate movement of
host material from the infested areas of California and all of Hawaii. This regulation
requires all nurseries, green waste facilities, community gardens and harvested commodities
within the infested areas be issued a quarantine compliance agreement and be inspected
every 30 days. On November 8, 2007, an emergency amendment to Section 3434 became
effective that removed a quarantined area in Oakley and Danville: however, new regulated
areas have been established since then in other portions of the County as LBAM continues
to be detected.
The State of California, Department of Food and Agriculture has established funding for
reimbursing the County for expenditures incurred for performing regulatory work for the
Light Brown Apple Moth, which includes implementing the Federal Domestic Quarantine
Order, and the California State Interior Quarantine, in addition to conducting emergency
response activities as a result of detections of LBAM in regulated establishments.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to approve Agreement #10-0738 will result in a loss of revenue to the Department of
Agriculture in the form of lost compensation for work performed from July 1, 2010 through
June 30, 2011.
