RECEIVE this report concerning the final settlement of Daniel Max and AUTHORIZE
payment from the Workers' Compensation Internal Service Fund in an amount not to exceed
$95,000 less permanent disability payments, as recommended by the Risk Manager.
FISCAL IMPACT:
Workers' Compensation Internal Service Fund payment of $95,000 less permanent disability
payments.
BACKGROUND:
Attorney Robert J. Cavallero, defense counsel for the County, has advised the County
Administrator that within authorization, an agreement has been reached settling the workers'
compensation claim of Daniel Max v. Contra Costa County Fire Protection District. The
Board's October 26, 2010 closed session vote was Supervisors Gioia, Uilkema, Bonilla and
Glover - Yes. Supervisor Piepho - Absent. This action is taken so that the terms of this final
settlement and the earlier October 26, 2010 closed session vote of this Board authorizing its
negotiated settlement are known publicly.
