APPROVE the conveyance of a Quitclaim Deed for a drainage easement and
Relinquishment of Abutter's Rights for access over a portion of Pleasant Hill Road to the
Stratford at Lafayette, LLC, pursuant to Government Code section 25526.5;
DETERMINE that the property interests to be conveyed are not necessary for county or
other public purposes, and that the estimated value of those interests does not exceed
$25,000; and
AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaim Deed and
Relinquishment of Abutter's Rights on behalf of Contra Costa County. Project No.
WL0072RP, SCH#88041927
FISCAL IMPACT:
There is no impact to the County General Fund. All costs are covered by developer’s fees.

Subject:Approve the Conveyance of a Quitclaim Deed and a Relinquishment of Abutter's Rights to The Stratford at
Lafayette, LLC, Lafayette area.
BACKGROUND:
On June 2, 1987, the Board accepted an Offer of Dedication for Drainage Purposes for
DP 85-03050 as described in Book 13693 at page 422, recorded June 8, 1987, Contra
Costa County Official Records and approved the Relinquishment of Abutter’s Rights for
DP 85-03050 along Pleasant Hill Road as described in Book 13693 Official Records at
page 418, recorded June 8, 1987, Contra Costa County Official Records.
On June 4, 1991, a permit was issued for DP 88-03007, which changed the development
plan for DP 85-03050.A portion of the underground storm drain conveying drainage from
Pleasant Hill Road to Diablo View Road has been realigned as a result of DP88-03007. A
condition of this permit was to provide legal access to the retirement and congregate care
housing facility from Pleasant Hill Road. In order to accomplish this the County needs to
relinquish approximately 49 feet along Pleasant Hill Road. On October 6, 2009, the
Board Accepted the Offer of Dedication for Drainage Purposes for DP88-03007 to reflect
the new pipe location as described in Series No. 2009-0237225, recorded October 7,
2009, Contra Costa County Official Records. A portion of the existing Offer of
Dedication for Drainage Purposes for DP 85-03050 should be quitclaimed since it is no
longer necessary. An EIR was prepared and certified for this project in 1989
(SCH#88041927)
CONSEQUENCE OF NEGATIVE ACTION:
The property will be encumbered with a drainage easement which is no longer necessary
for public purposes.
