Williamson Charitable Remainder Trust, et al. Government code 25350, (District V) AUTHORIZE the Chief Engineer, or designee to execute said Purchase and Sale Agreement on behalf of the District. APPROVE payment of $45,000.00 for said property rights and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to North American Title Insurance Company, 645 San Ramon Valley Boulevard, Danville, CA 94526, Escrow No. 54705-911131-09, to be forwarded to the Real Property Division for delivery. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the office of the County Recorder. Project No. 7562-6D8518 FISCAL IMPACT: Payment of $45,000.00 from Drainage 130 Area funds. BACKGROUND: The Contra Costa County Flood Control and Water Conservation District (District) plans to expand the Upper Sand Creek Basin (USCB) located in the southeast portion of the City of Antioch (Antioch), south of Lone Tree Way, east of Deer Valley Road, north of Balfour Road, and west of State Route 4 Bypass. In 1992, this Board as governing Board of the District, approved the Final EIR for Sand Creek watershed improvements. This EIR considered eight alternatives made up of various detention basin sites throughout the watershed. After careful consideration, the Board chose Alternative 8, which included USCB in its current location. Phase One of USCB was constructed in 1994 as part of Assessment District 27 in Antioch. The interim UCSB currently receives local runoff from the adjacent subdivisions. The expansion will provide regional flood protection benefits for downstream communities. The expanded UCSB will receive runoff from the surrounding 11 square miles of tributary areas. The USCB expansion project (Project) consists of excavating ± 255,000 cubic yards of soil from the existing interim basin to create a deeper basin for holding stormwater during major storm events, then slowly releasing this stormwater through the outlet pipe, reducing peak flows downstream in both Sand and Marsh Creeks. The project will expand the interim basin to the ultimate size, increasing it from approximately 120 to 1,000 acre-feet of capacity. The project also includes the construction of a “fill” dam along the easterly (downstream) side of the site, which will impound floodwater. A Notice of Determination was filed and Posted on September 14, 1992. [#CP 88-69 (SCH #90030280)] CONSEQUENCE OF NEGATIVE ACTION: The District will not have the necessary property rights to expand USCB to its ultimate configuration.
