Approve contract with the Volunteer Center of Contra Costa County in the amount of $2,500 for the period January 1, 1985 to January 31, 1985 and authorize County Administrator or his designee to execute. the contract on behalf of the County and any amendments thereto; said contract to provide community service sentencing options for the Walnut Creek- Danville, Mt. Diablo, and Delta Municipal Courts. 2. Direct the County Administrator to explore with the municipal court judges the need for and desirability of this program, and options for funding the court referral program for the balance of the fiscal year and thereafter. Background and Justification The Volunteer Center of Contra Costa County has, for a number of years, operated a court referral program which places minor offenders from the municipal courts in community service programs. The municipal Courts view this as a needed option to deal with minor offenders who cannot, by law, be sentenced to jail (i.e., infractions) or who are otherwise inappropriate for County jail. The ability to place such offenders in various community service programs is seen as a valuable tool to deal with these offenders and to provide restitution to society. Until fiscal year 1982/83, this contract with the Volunteer Center was administered by the Probation Department on behalf of the courts, with the money charged to the budgets of the four municipal courts based upon number of referrals. As a result of budget cutbacks, the Probation Department had to forego its administration of this program. In fiscal year 1983/84, a $27,000 contract was administered by the Delta Municipal Court on behalf of all the courts. In the current fiscal year, only the Bay Municipal Court has an agreement with the Volunteer Center ($13,700) . The Center has been able to continue its court referral program because of its United Way and other funding. The Board of Directors of the Volunteer Center has received notice from United Way that its funds can no longer be used to subsidize this program. Consequently, the Center has given notice to the County that it must pay for this program or the program will be terminated. Although the program does collect fees from offenders who are able to pay, this is minimal and will approximate $6,000 for this fiscal year. In order for the Volunteer Bureau to continue operation until June 30, 1985, $22,000 is required for the six-month period ending June 30, 1985. Of this amount, $6,850 is committed by the Bay Court, $3,000 is estimated from fees, $2,500 is being recommended for January, leaving a deficit of $9,650 to fund the Center through June 30, 1985. DEPUTY Contract with Volunteer Center' of Contra Costa County January 8, 1985 Page 2 It is recommended that the contract be approved in the amount of $2,500, to be allocated among the Delta, Mt. Diablo, and Walnut Creek-Danville Municipal Courts for the month of January. The intent of the one-month contract is to allow time for discussion between this Office and those three municipal courts concerning the continuation of this program for the balance of the fiscal year and to begin to plan for a longer-term approach to the problem of making available to the courts a community service sentencing option. The three municipal courts concur in this approach.
