FISCAL IMPACT: No funds are being exchanged. There is no impact to the County General Fund. Bueren, Public Works Director/Chief Engineer Date:November 9, 2010 Contra Costa County Subject:Hap Magee Ranch Park; Acceptance of Grant Deed from the Public Facilities Corporation as Tenant in Common with the Town of Danville Area BACKGROUND: (CONT'D) holds title to property known as Hap McGee Ranch Park located in Danville. In anticipation of the dissolution of the PFC, all property must be transferred out of the PFC. When Hap McGee Ranch Park was acquired by the PFC, the County and the Town of Danville (Town) each contributed one-half of the purchase price, pursuant to an acquisition agreement dated May 26, 1987. The parties intended that eventually the County and the Town would each own an undivided one-half interest in the property. To satisfy the parties’ original intent, the PFC is transferring the property to the County and the Town to hold as tenants in common, with each owning an undivided one-half interest. Maintenance of the property will continue to be governed by an existing Joint Powers Agreement (JPA) created in 1987 for that purpose. The County may acquire real property pursuant to Government Code section 25353. CONSEQUENCE OF NEGATIVE ACTION: The PFC will continue to hold title to the property, preventing the dissolution of the PFC. CHILDREN'S IMPACT STATEMENT: Not Applicable.
