Persons who wish to address the Board of Directors should complete the form provided for that purpose and furnish a copy of any written statement to the Clerk. Broschard III, Fire Chief RE: Fire Chief’s Report ______________________________________________________________________  Coronavirus Planning. The District has taken steps to prepare for the potential spread of the virus. We have implemented changes to our Emergency Medical Dispatch (EMD) questions of 911 callers regarding recent travel to China so we can provide appropriate information to our responders as well as alert receiving hospitals of possibly infected patients. As the situation develops, we are closely monitoring guidance from Centers for Disease Control and California Department of Health and updating our threat assessment. Our Medical Director, EMS Chief, and Ambulance Transport Program management are in daily contact with each other for information sharing, discussion of protocol changes/implementation and are in contact with county EMS staff and the State EMS Authority as needed.  High School Hands-Only CPR Training Program. This important initiative to help drive up cardiac event survivability across the County continues to gain momentum with several high schools across the District opting in this year. In January and February, multiple training sessions were conducted by AMR and CON Fire personnel at all Mount Diablo Unified School District high schools. At the beginning of February, approximately 5,000 of our stated goal of 10,000 students were trained. We continue to reach out to remaining high schools in the hopes of providing training to their students, as well.  Lucas Device Update. Lucas mechanical chest compression devices demonstrated at the December Fire Board meeting were placed in service last week. These easy- to-use lifesaving CPR units are now available on every District engine and truck to help our crews deliver high quality and consistent chest compressions to sudden cardiac arrest patients at every incident where they may be needed.  Academy 54 Update. Academy 54 is days away from completion with graduation scheduled for this Thursday, February 13, at 5 p.m. at the Lesher Center for the Arts in Walnut Creek. This is one of the most important events for the District, our recruits and their families and friends, and the communities we serve. All of the above, including District residents, are invited to attend and celebrate with us. Fire Chief’s Report – February 11, 2020 Page 2  Academy 55 Update. Candidates for this relatively small and abbreviated Lateral Firefighter-Paramedic Academy are currently in the medical screening process. We expect to begin this abridged, 10-week academy with approximately 10 experienced firefighter-paramedics in mid-April.  Fire Control Worker Recruitment. Interviews were conducted last week to identify 10 to 12 qualified candidates for the new hand crew program. Hiring will follow in May.  REACH Partnership. Con Air 1 remains at Mather Field where maintenance issues have delayed its in-service date until at least the end of February. In conjunction with the arrival of Con Air 1, we will plan a media event to communicate the many positive attributes of this unique partnership. Con Air 2 continues to provide air ambulance services and has been busy with transports from within Contra Costa County as well as adjacent counties.  US&R Search Dog Handler Update. The District continues to move forward with the plan to add a canine handler from our existing ranks of FEMA Urban Search and Rescue Task Force 4 personnel. Three potential candidates have been selected and will undergo an observation period by the task force that will inform a decision later this month as to which handler will attend training on the east coast later this year.  Pine Street High-Rise Training Drills. This training for these low-frequency, yet high- risk incidents was completed in late December. More than 250 CON Fire firefighters, along with firefighters from San Ramon Valley, Pinole, and Rodeo-Hercules, completed the training which assures we are better prepared in the event they are called on to respond to a high-rise fire.  Firefighter Injuries. Our occupation is a dangerous one, and that was proven out in two January incidents with two of our firefighters suffering injuries responding to structure fires. In one case, which could have been much worse, a firefighter fell through a second-story floor resulting in falling debris injuring a firefighter below. Neither of these firefighters was seriously injured, and both returned to duty soon after the incident. In a second incident, a firefighter suffered a fractured ankle requiring loss of duty time while recuperating.  Development Impact Fees. Antioch and Pittsburg have adopted the revised impact fees approved by the Board of Supervisors earlier this year.  Additional Fire Inspectors. Two new Fire Inspectors started with the District in December. This increases code enforcement staffing from 7 to 9 Fire Inspectors. We are expecting two retirements in March and have initiated a recruitment for Fire Inspector I and Fire Inspector II positions.  Fire Prevention Software. Procurement of a new inspection records management system and invoicing program is in process. We anticipate the new program will be installed and tested by July. This is one of the key components identified in the 2019 Grand Jury report regarding the Fire Prevention Bureau. Fire Chief’s Report – February 11, 2020 Page 3  NuStar Investigation Update. The investigation team continues to work on the investigation. We anticipate being able to complete the investigation and associated reports by the end of March.  Emergency Generators. As part of ongoing planning and preparedness for PSPS events and disasters, we have applied for several grants for replacement of older fixed generators at our stations as well as new towable emergency generators. We were awarded funds for one towable generator as part of the State Homeland Security Grant program ($92,000 with no matching funds) and replacement of the older fixed generators at Fire Station 2 in Pleasant Hill and Fire Station 81 in Antioch under the FEMA Hazard Mitigation Grant Program ($614,960 total with 25% matching funds). Installation and delivery is expected in 2021 due to grant funding timelines. Broschard III, Fire Chief RE: Update on Fire Station Construction Projects ______________________________________________________________________  Fire Station 9 – Pacheco A significant challenge has arisen regarding obtaining CEQA clearance for the Pacheco Fire Station. There is a flood control issue that requires mitigation before proceeding with construction drawings. Fire District staff is working collaboratively with the airport and other Public Works staff in order to identify a solution. This delay will most likely result in Fire Station 9 and Fire Station 86 being put out to bid separately.  Fire Station 70 – San Pablo Construction is proceeding. Large steel columns have been set, and vertical construction has commenced. We are still projecting a spring 2021 opening.  Fire Station 86 – Bay Point The new building codes went into effect on January 1, 2020. Although the project has already been approved by the zoning administrator, the architect is currently updating our construction drawings to be compliant with the 2020 codes before submitting a request for a building permit. A prequalification process for general contractors is underway in order to establish a list of eligible builders while staff is also exploring financing options. Later this year, the District expects to seek Board authorization to put the project out to bid. Broschard III, Fire Chief RE: Report on New Hand Crew Program ______________________________________________________________________ As a result of increasing demands on fire resources during the summer and fall fire season, we are introducing a 12-person hand crew to District operations in 2020. In our first year, the hand crew will primarily be responsible for weed abatement projects, fuel reduction and mitigation projects, fire trail maintenance, and response to support fire crews with equipment and apparatus restoration and rehabilitation at fire scenes. Additionally, there will be training and development of the personnel assigned to the crew to prepare for the advancement of the crew’s capabilities as we progress through the 2020 fire season and into the second year of operations. In addition to the District’s weed abatement contractor, the hand crew will support various weed abatement projects throughout the District. Certain targeted fuel reduction or hazard mitigation projects can be supported by the crew in coordination with city and county public works or code enforcement agencies. The District’s fire trail program will be enhanced by additional maintenance and removal of brush or overhanging limbs that could obstruct fire engine access. The hand crew will be supporting fire operations by assisting crews in removing hose and equipment from large wildland incidents and getting fire engines back in service and returned to their stations more quickly. The crew will be split with 6-8 personnel on duty each day. They will be mobilized using a 10-15 passenger van, pickups, as well as a stake side utility vehicle. They will be equipped with weed eaters, various powered saws, and other equipment necessary to carry out their maintenance and vegetation management tasks. In addition, the stake side utility vehicle will be carrying several thousand feet of fire hose which can be easily loaded onto fire engines as replacement for hose used at an incident – the hand crew will retrieve the used hose at the scene, clean it, and return it to service. Utilizing the hand crew in this capacity will result in engine companies returning to service faster. The hand crew will be staffed by temporary seasonal employees and supervised by permanent Fire Captains on a rotation throughout the fire season. The new temporary seasonal classification of Fire Control Worker was established in late 2019 by the Board. It is anticipated the Fire Control Worker positions will be filled and training will commence in May. Operations are expected to begin in June, commencing with the traditional start to the fire season. The hand crew will be unstaffed at the end of October, or later if fire conditions persist. If the first year of operations is successful, we will look to expand the hand crew capabilities to include response to wildland fires in direct support of fire suppression activities in 2021. As the District continues to plan for and respond to prolonged fire seasons, we are hopeful this will become a sustainable resource to assist us in providing increased operational capacity for our wildland fire suppression mission. FISCAL IMPACT: The fiscal impact is neutral, except for those occasions where reimbursement may be paid to other agencies for battalion chief coverage. BACKGROUND: The original Battalion 7 Automatic Aid Agreement (“Agreement”) concept between the City of Pinole, Rodeo-Hercules Fire Protection District, and the Contra Costa County Fire Protection District dates back to the late 1990s. The overall concept of cooperation amongst these agencies was identified as necessary based on each agency’s staffing, the geography of West Contra Costa County, and the need for closer coordination of resources to safely and successfully mitigate incidents within the respective jurisdictions. There has been at least one revision to the Agreement since its inception. The communities of North Richmond and East Richmond Heights are not necessarily directly served by all parties to the Agreement; however, they receive the benefit of automatic aid and mutual aid from the Battalion 7 agencies, when needed. The area served by the Crockett-Carquinez Fire Protection District are not included in this Agreement. This revision to the Agreement was developed in collaboration with the Fire Chiefs of the Rodeo-Hercules Fire Protection District and the City of Pinole Fire Department. The intent of the revision was to capture and document current operational practices and combined philosophy of providing service to the areas within Battalion 7. This Agreement provides for a consistent staffing requirement for all parties; ensures advanced life support (paramedic) staffing of all units within Battalion 7; requires all parties to adequately equip their agency with primary and reserve fire apparatus and to operate under common communications and operational procedures; outlines consistent daily reporting and supervision activities of the shared battalion chiefs; and provides a mechanism for financial reimbursement between agencies for battalion chief coverage, when necessary. This Agreement does not contain any provision for financial compensation between the agencies for incidents or responses. CONSEQUENCE OF NEGATIVE ACTION: The current agreement would remain in effect without the necessary improvements and requirements contained in the revised agreement. BACKGROUND: The Contra Costa County Fire Protection District (District) has a need for clinical education services to develop and provide clinical care training programs, conduct continuous quality improvement reviews, and enhance the overall clinical care provided by the District’s employees and contractors. The District will contract with REACH Air Medical Services LLC to provide qualified personnel to provide clinical education services to the District. Contractor will provide up to four clinical education/training classes per training calendar year, with topics selected by District, as well as Paramedic and Emergency Medical Technician certification courses. Contractor will conduct an ongoing clinical continuous quality improvement review of District medical calls. Additionally, acting as the District’s On-Call Infection Control Officer, Contractor will take calls from District personnel and provide direction regarding potential exposures to infectious diseases for up to 12 days per month. (Sacramento Superior Court Case No. 34-2012-00127517), requiring Sprint to pay the Contra Costa County Fire Protection District $5,633.14, as recommended by the Fire Chief. APPROVE and AUTHORIZE the Fire Chief to complete and return, on behalf of the Contra Costa County Fire Protection District, a consent and release for non-intervenors, to agree to the terms of settlement and to release Sprint from claims that were raised or that could have been raised in the lawsuit. Cellco Partnership d/b/a Verizon Wireless, et al. BACKGROUND: This board order authorizes the Contra Costa County Fire Protection District (District) to participate in a settlement with Nextel of California, Inc. (dba Sprint Nextel and Nextel Communications) and Sprint Solutions, Inc., (collectively, “Sprint”) in a False Claims Act lawsuit filed on behalf of the State of California and several public agencies against several wireless carriers. The lawsuit, State of California ex rel. OnTheGo Wireless, LLC v. Cellco Partnership d/b/a Verizon Wireless, et al. (Sacramento Superior Court Case No. 34-2012-00127517), alleges that several wireless carriers, including Sprint, billed public agencies more than they agreed to bill under multi-agency contracts for wireless services. The District participated in those contracts and paid Sprint approximately $161,608 for wireless services under the contract during the period covered by the lawsuit (2006-2012). The relator OnTheGo Wireless, LLC, (“Relator”) litigated this lawsuit on behalf of the State of California, Contra Costa County, and several other cities, counties, and public agencies. The District received a notice that the Relator has agreed to a settlement with Sprint. This settlement will require Sprint to pay a total of $9,220,391, plus attorney’s fees, for its alleged unlawful conduct. The Court will consider giving final approval of the settlement with Sprint on March 17, 2020. If the Court approves the settlement, and if the District signs and returns a release form by February 18, 2020, the District will receive $5,633.14 from the Sprint settlement funds. The release form will release Sprint from all claims related to its alleged unlawful billing practices that were raised or could have been raised in this litigation. If the District does not sign and return a release form and the court approves the settlement, the District's settlement amount would be reduced by 10 percent. The Fire Chief recommends approving the partial settlement with Sprint and authorizing the execution and return of a release form, to ensure that the District receives the full amount of its allocation of settlement funds. CONSEQUENCE OF NEGATIVE ACTION: If the District takes no action and the court approves the settlement, the District would only receive approximately $5,069.82 in settlement funds.
