NOES: None . ABSENT: None . ABSTAIN: None . SUBJECT: Determination of Property Tax ) Exchange for Paso Nogal No. 55) Boundary Reorganization ) RESOLUTION 85/14 (LAFC 84-45) ) WHEREAS , Section 99 of the Revenue and Taxation Code provides that the City and the County shall agree by resolution to exchange property tax revenues among themselves and any affected agencies; and WHEREAS , the Paso Nogal No. 55 Boundary Reorganization (LAFC 84-45)consistinq of parcels in tax rate area 79082 and 79111 involves annexation of territory to the City of Pleasant Hill for which property tax exchange is determined by the previously approved Master Property Tax Exchange agreement; and WHEREAS , the Reorganization proposes concurrent annexation of the territory in tax rate area 79111 to the Pleasant Hill Recreation and Park District which would result in the district providing services in an area where such services have not been previously provided and where Section 99 . 1 of the Revenue and Taxation Code provides for the annexing agency to negotiate for a portion of the growth property tax in the affected territory; and WHEREAS , the Reorganization also proposes concurrent detach- ment of the territory in tax rate area 79082 and 79111 from County Service Area L-42 (CSA L-42) which will result in the transfer of zero property tax from CSA L-42 ; and WHEREAS , for the property tax allocation to be made under this resolution the Auditor-Controller of Contra Costa County shall first apply the provisions of the Master Property Tax Agreement between the City of Pleasant Hill and the County and then apply the tax incre- ment allocation factors for property tax increment apportionment to the Pleasant Hill Recreation and Park District, as shown on the attached schedule marked Exhibit "A" with respect to tax rate area 79111 ; THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that in accordance with Section 99 of the Revenue and Taxation Code the property tax increment allocation factors for the affected agencies in the area of the Paso Nogal No. 55 Boundary Reorgani- zation (LAFC 84-45) for the fiscal year for which the State Board of Equalization makes the tax rate area change (s) for the jurisdictional change and subsequent years , unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes shall be as shown on the attached schedule with respect to tax rate area 79111 (Exhibit "A" Said increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the property tax revenues accruing to other agencies serving the subject territory or the affected districts ' right to collect taxes for existing bonded indebtedness. SUBJECT: Determination of Property Tax Exchange) for County Service Area R-7 (CSA R-7) ) RESOLUTION NO. 85/13 Boundary Reorganization (LAFC 84-27) ) WHEREAS, the Board of Supervisors of Contra Costa County has initiated proceedings for detachment of certain territory from CSA R-7; and WHEREAS, Section 99 of the Revenue and Taxation Code provides that a jurisdictional change affecting one or more special districts shall not become effective until the Board of Supervisors agrees by resolution to an exchange of property .tax revenues among affected agencies; and WHEREAS, Contra Costa County is the only agency affected by the subject reorganization. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Contra Costa County does hereby determine that 100% of the property tax accruing to CSA R-7 from the affected territory of the County Service Area R-7 Boundary Reorganization (LAFC 84-27) shall be trans- ferred to the County of Contra Costa. This Resolution does not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies' right to collect taxes for existing bonded indebtedness. SUBJECT: Determination of Property Tax ) Transfer for Annexation No. 262) RESOLUTION NO. 85/12 to West Contra Costa Sanitary ) District (LAFC 84-39)' ) WHEREAS, Section 99 .1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been previously provided shall not become effective if one or more affected special districts involved in the property tax exchange negoti- ation fails to adopt a resolution agreeing to a transfer; and WHEREAS , the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer except for the annexing district; and WHEREAS , Annexation No. 262 to West Contra Costa Sanitary District (WCCSD) (LAFC 84-39) proposes annexation of territory which results in provision of services not previously provided and no resolu- tions have been adopted agreeing to property tax exchanges; and WHEREAS, in the absence of a master agreement for property tax exchange between the County and WCCSD, the County and WCCSD have agreed that the property tax exchange agreement for this annexation will be in accordance with the terms of the existing master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District. THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of Annexation No. 262 to the West Contra Costa Sanitary District (LAFC 84-39) for- the fiscal year for which. the State Board of Equalization makes the tax rate area change (s) for the jurisdictional change and subsequent years, unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes shall be in accordance with the above master agreement and that the Auditor-Controller is directed to apply the terms of the master agreement between the County and •the Central Contra Costa Sanitary District and the East Bay Municipal Utility District to the subject annexation, said increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commis- sion.
