Approve and authorize the Health Services Director, or his designee (Art Lathrop), to
execute, on behalf of the County, Agreement #23-474 with the State of California, Office of
Administrative Hearings, a government agency, to allow the State to conduct hearings for
disciplinary actions against EMT-1 certification as required by State regulations. This
Agreement will remain in effect until terminated by either party upon sixty days written
notice.
FISCAL IMPACT:
None. Cost to County is 100% reimbursed from EMT-1 Certification Fees and Measure H
Funds.
BACKGROUND:
In the event the Contra Costa County Emergency Medical Services (EMS) Division denies
or takes other action against an EMT-I certification under a new statute and regulations on
EMT-I disciplinary procedures, the County is required to schedule any appeal with the State
of California, Office of Administrative Hearings (OAH). The County only has fifteen (15)
days from the

appeal request to notify the individual of the OAH hearing. This agreement is necessary to
schedule hearings through OAH.
Approval of Agreement #23-474 will enable the County to utilize the hearing services of the
State of California as required by law and regulation until this agreement is terminated by
either party upon sixty days written notice.
CONSEQUENCE OF NEGATIVE ACTION:
If this agreement is not approved, the County will not be able to conduct required appeals
hearings and would, therefore, be unable to enforce EMT-I certificate denials or disciplinary
actions, which would create a potential danger to the public health and safety and place the
County at risk for liability.
