Correct the Board Order which was approved by the Board of Supervisors on August 3,
2010, C.30 to terminate Contract with David H.C. Raphael, M.D., for provision of general
surgery services for patients at Contra Costa Regional Medical Center and Contra Costa
Health Centers, to reflect the intent of the parties in which the termination date should read
close of business on December 31, 2010 instead of November 3, 2010.
FISCAL IMPACT:
This Contract was funded by Enterprise Fund I.
BACKGROUND:
On May 5, 2009, the Board of Supervisors approved Contract #26-938-11 (as amended by
Amendment Agreement #26-938-12) with David H.C. Raphael, M.D., in an amount not to
exceed $600,000, for provision of general surgery services, including consultation, clinic
coverage, training, medical and/or surgical procedures, and on-call coverage for patients at
Contra Costa Regional Medical Center and Contra Costa Health Centers, for the period
from June 1, 2009 through May 31, 2011. On August 3, 2010, the Board of Supervisors
approved termination of Contract #26-938-11, as amended,

BACKGROUND: (CONT'D)
to allow the County to re-negotiate the payment provisions to fee for service rate, effective
November 3, 2010.
The purpose of this Board Order is to correct the termination date from November 3, 2010
to December 31, 2010 to reflect the intent of the Department, therefore allowing the
Contractor to continue to provide services and allow the County time to negotiate Contracts
for general surgery services at Contra Costa Regional Medical and Contra Costa Health
Centers.
CONSEQUENCE OF NEGATIVE ACTION:
If this contract is not approved, patients requiring these medical services at Contra Costa
Regional Medical and Contra Costa Health Centers would go untreated.
