HomeMy WebLinkAboutMINUTES - 11022010 - C.38RECOMMENDATION(S): APPROVE and AUTHORIZE the County Probation Officer, or designee, to execute a contract with the State of California, Franchise Tax Board (FTB), including modified indemnification language, for the collection of unpaid, court-ordered fees via tax intercept, for the period October 1, 2010 through September 30, 2011. FISCAL IMPACT: Actual cost to the Probation Department will not exceed 15% of debt collected by the Franchise Tax Board. There is no net County cost. TOTAL COMPENSATION IMPACT: No Impact. PENSION IMPACT : No Impact. Kader, County Probation Officer Date:November 2, 2010 Contra Costa County Subject:Agreement with Franchise Tax Board (FTB) BACKGROUND: (CONT'D) collecting debt owed for parental responsibility for care of youth in Juvenile Hall and the Orin Allen Youth Rehabilitation Facility. The Probation Collections Unit also collects Adult Public Defender and Juvenile Electronic Monitoring fees. Previously, this debt was collected by the Office of Revenue Collections, which is discontinuing service. This form of collection is authorized under the provisions of Revenue and Taxation Code (R&TC) Section 19280 through 19283. This approval will be in effect through September 30, 2011. CONSEQUENCE OF NEGATIVE ACTION: Negative action will result in no access to tax refunds issued by the State of California to certain debtors for fees owed to the Probation and Public Defender departments. CHILDREN'S IMPACT STATEMENT: No Impact.
