APPROVE the conveyance of real property to Kevin Blackwell and Michelle Blackwell
(Grantees), in accordance with the Real Property Agreement and pursuant to Government
Code Section 25526.5. Antioch area. (District V) [DCD-CP#07-102] Project No.:
7566-6D8419.
DETERMINE that the project is exempt from the requirements of the California
Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061 (b) (3) of the State
CEQA Guidelines, and DIRECT the Director of the Department of Conservation and
Development (DCD) to file a Notice of Exemption with the County Clerk and DIRECT the
Chief Engineer to arrange for payment of a $50.00 handling fee to the County Clerk for
filing and a $25.00 fee to DCD for processing of the Notice of Exemption. (CP #09-28)
DETERMINE that said property is no longer necessary for Contra Costa County Flood
Control and Water Conservation District (District) or other public purposes, and its
estimated value does not exceed twenty-five thousand dollars ($25,000).
AUTHORIZE the Public Works Director, or designee, to execute the Real Property

Agreement on behalf of the District.
RECOMMENDATION(S): (CONT'D)
AUTHORIZE the Chair, Board of Supervisors, to execute a Quitclaim Deed on behalf of
the District.
DIRECT the Real Property Division of the Public Works Department to cause said
Quitclaim Deed to be recorded.
FISCAL IMPACT:
There is no fiscal impact to the County General Fund.
BACKGROUND:
In 1995, the District purchased a ±3.95 acre portion of real property identified as APN
065-102-041 described in the Grant Deed (Deed) recorded on January 3, 1996, Book 96
Page 988, and hereinafter called “District’s Property”, from George Curtis and Faye
Curtis, Trustees of the Curtis Family Trust, established April 5, 1991, and Glenn O.
Wristen and P. Ada Wristen (Grantors). At the time the Deed was granted, neither the
District nor the Grantors reserved access rights across District’s Property to Grantors’
adjacent property identified as APN 065-102-040.
On March 11, 2005, Grantees purchased APN 065-102-040, hereinafter called “Grantees’
Property”. Grantees’ Property is improved with a residential duplex whose only access
from Marie Avenue is over a ±4,600 square foot portion of the District’s Property as
described in Exhibit “A” and shown on Exhibit “C”, attached hereto and hereinafter
called “Access Area”.
On June 12, 2007 Grantees were sent written notice that the District was planning to
fence off the Access Area due to excessive dumping from various residents and access
would no longer be available. Grantees subsequently contacted the District to secure
these access rights.
The District determined that the Access Area is no longer needed for flood control
purposes and agrees to convey the Access Area in fee title and at no cost to Grantees.
CONSEQUENCE OF NEGATIVE ACTION:
The District will be responsible for the liability and maintenance of this property.
