ADOPT Resolution No. 2010/542 approving the Side Letter of Agreement between the
County and SEIU, Local 1021 granting employees in the classifications of Medical Social
Worker I, Medical Social Worker II, and Medical Social Worker-Project in the Crisis
Stabilization Unit to work schedules that includes variable daily work hours, as
recommended by the Human Resources Director.
This side letter is retroactive to October 1, 2008.
FISCAL IMPACT:
No Fiscal Impact.
BACKGROUND:
Due to staffing and the nature of the work the Medical Social Workers in the Crisis
Stabilization Unit perform; it is necessary for some employees to work schedules that
include variable daily work hours. These employees may be assigned to a schedule that has
one or more work days with less than 8 hours of work time, one or more work days with 8
hours of work time, and

BACKGROUND: (CONT'D)
one or more work days with more than 8 hours of work time, but with a cumulative total
of work hours that does not exceed 40 hours in a workweek. Overtime pay or overtime
compensation time will only be paid for hours worked that exceed 40 hours in a
workweek.
A side letter of agreement was signed by the County and SEIU Local 1021 on January
22, 2009 to allow these schedules to be implemented retroactively to October 1, 2008.
CONSEQUENCE OF NEGATIVE ACTION:
If this action is not approved by the Board, it will negatively impact the Department by
not allowing the Crisis Stabilization Unit the flexibility to properly staff the Unit with
Medical Social Workers.
