Adopt Resolution No. 2010/516 approving the Memorandum of Understanding between
Contra Costa County and the Professional & Technical Engineers Local 21, AFL-CIO,
implementing negotiated wage agreements and other economic terms and conditions of
employment beginning October 26, 2010 through June 30, 2011. The Union ratified the
agreement on October 13, 2010.
FISCAL IMPACT:
The anticipated savings from agreed upon temporary absences are equivalent to a
twenty-four month 2.31% wage reduction. Although the conclusion of negotiations took
longer than with some other units, the County was able to negotiate agreement for the full
two-year savings to be achieved in under nine months. The savings will help to alleviate the
current local fiscal impact caused by reductions in assessed valuation and related decline in
property tax revenues.
BACKGROUND:
The Professional & Technical Engineers, Local 21, AFL-CIO (Local 21) was formally
recognized in June 2009 and began bargaining with Contra Costa County in July 2009.

During the months since, the County and the Union have created an original Memorandum
of Understanding and reached Tentative Agreement on September 24, 2010. The
Memorandum of Understanding, which is attached, includes wage and health care premium
subsidy changes consistent with other completed contracts.
The Local 21 contract includes 96 hours of unpaid Agreed upon Temporary Absences
(ATA) to be taken on or before June 30, 2011. These ATA days are equivalent to a
twenty-four month 2.31% wage reduction.
The contract also includes Health Plan changes, making Local 21's premium subsidy
equivalent to unrepresented and Coalition employees.
BACKGROUND: (CONT'D)
Dual Coverage. Provide as of 01/01/11, that employees and retirees and dependents of
employees and retirees can no longer have dual coverage in two County/District health or
dental plans. This provision will apply to County and District employees and retirees who
have spouses or partners who are either County or District employees or retirees.
Premium Cost Sharing 2010-2011. (Other Than CalPERS Plans)
Contra Costa Health Plan and Coordinated Dental Plans – Currently shared 98%
County, 2% Participant for Plan A and 90% County, 10% Participant for Plan B.
Effective 01/01/11, County will pay a premium subsidy equal to 93% of the
2010 premium for Plan A and Participant will pay an amount equal to 7% of
the 2010 premium for Plan A. County will pay an amount equal to 87% of the
2010 premium for Plan B and Participant will pay an amount equal to 13 % of
the 2010 premium for Plan B. Any premium increases for 2011 in Plan A and
Plan B to be shared 50% by the County and 50% by the Participant, up to a
maximum of 11%; portion of increase above 11% to be paid by the County.
Kaiser and Health Net HMO and dental plans – Increases 01/01/10 and 01/01/11
to be shared 50% by the County and 50% by the Participant, up to a maximum of
11%; portion of increase above 11% to be paid by the County.
Health Net PPO- Increases 01/01/10 and 01/01/11 to be shared 50% by the County
and 50% by the Participant.
Fixed Premium. Effective 06/29/11, fix the County monthly premium subsidy for
all of these plans at the May 2011 amount.
Premium Cost Sharing 2010-2011. (CalPERS Plans)
All plans currently shared based on Bay Area Kaiser premium rate at 87% County,
13% Participant.
Based on that rate, increases 01/01/10 and 01/01/11 to be shared 50% by the
County and 50% by the Participant, up to 11%; portion of increase above
11% to be paid by the County.
Fixed Premium. Effective 06/29/11, fix the County monthly premium subsidy
for all CalPERS plans at the May 2011 amount County pays for the Bay Area
Kaiser premium.
One Rate Pool. Eliminate provision applicable to management and unrepresented
employees that would have established separate rate pools during employment and upon
retirement for new employees hired on or after 01/01/09.
Dental Plan Benefit. Increase to $1800, from $1600, the annual maximum benefit
available in the Delta Dental Insurance plan effective 01/01/11.
The Tentative Agreement is for status quo on other benefits.
CONSEQUENCE OF NEGATIVE ACTION:
County will fail to receive value of ATA and other changes.
