DECLARE vacant the Board of Supervisors Appointee #9 seat on the Contra Costa County
Employees Retirement Board, previously held by Paul Katz due to his death; and DIRECT
the Clerk of the Board to post the vacancy.
FISCAL IMPACT:
No fiscal impact on the County General Fund.
BACKGROUND:
On October 13, 2010, Mr. Paul Katz passed away, leaving a vacancy for Seat #9 on the
Contra Costa County Employees Retirement Board. By Board of Supervisors resolution, if
there is a vacancy with respect to the 4th, 5th, 6th, or 9th seat, the Alternate member shall
fill that vacancy until the Board of Supervisors appoints a regular member. This process is
also established in statute (County Employees Retirement Law of 1937, Sec. 31520.12),
which states: "If there is a vacancy with respect to the fourth, fifth, sixth, or ninth member,
the alternate member shall fill that vacancy until a successor qualifies."
Therefore, Mr. Jerry Holcombe, the Alternate to Seats 4, 5, 6, and 9, will

automatically fill Seat #9 until the Board of Supervisors makes a new appointment. The
Internal Operations Committee will conduct the process for making a nomination to the
Board of Supervisors for appointment to Seat #9 on the Retirement Board, which includes a
recruitment process.
CONSEQUENCE OF NEGATIVE ACTION:
Seat will not be filled.
