Approve and authorize the Health Services Director or his designee, to execute, on behalf of
the County as follows:
1. Cancellation Agreement #26-856-28 with Diablo Pulmonary Medical Group, a
corporation, effective on the close of business on September 30, 2010; and
2. Contract #26-856-29 with Diablo Pulmonary Medical Group, a corporation, in an amount
not to exceed $227,700, to provide pulmonary disease services for patients at Contra Costa
Regional Medical Center and Contra Costa Health Centers, for the period from October 1,
2010 through September 30, 2013.
FISCAL IMPACT:
This Contract is funded 100% by Enterprise I Budget. Cost to the County depends upon
utilization. As appropriate, patients and/or third-party payors will be billed for services. No
increase in rates.

Subject:Cancellation Agreement #26-856-28 and Contract #26-856-29 with Diablo Pulmonary Medical Group
BACKGROUND:
On December 16, 2008, the Board of Supervisors approved Contract #26-856-24 (as
amended by Amendment Agreement #26-856-26 and #26-856-27), with Diablo Pulmonary
Medical Group, Inc., for the period from November 1, 2008 through October 31, 2011, to
provide pulmonary disease services, including, but not limited to, clinical coverage,
consultation, training, on-call and surgical procedures, for patients at Contra Costa Regional
Medical Center and Contra Costa Health Centers.
In consideration of Contractor’s agreement to continue providing services, both parties have
agreed to re-negotiate payment terms. This will allow the Contractor continue to be paid at a
per clinic rate instead of a monthly rate. Therefore, in accordance with Special Conditions,
Paragraph 2. (Modification to Termination and Cancellation) of the Contract, the
Department and Contractor have agreed to a mutual cancellation of Contract #26-856-24 (as
amended by Amendment Agreement #26-856-26 and #26-856-27). Approval of
Cancellation Agreement #26-856-28 will accomplish this termination.
Under Contract #26-856-29, Contractor will provide professional pulmonary services,
including, consultation, clinic coverage, training, on-call services, and medical and/or
surgical procedures, through September 30, 2013.
CONSEQUENCE OF NEGATIVE ACTION:
If this contract is not approved, patients requiring these medical services at Contra Costa
Regional Medical and Contra Costa Health Centers would go untreated.
